Your Favorite Adult Companies Give Up Info To Gov

I was reading over the FTC?s website about this spam crap that recently took place. What I found was mind blowing. This isn?t a bash against the companies that settled but it is fucked up. They agreed to some very fucked up terms. Companies that settled are: (BangBros.com Inc, RK NetMedia Inc, Ox Ideas, Inc) (MD Media) (APC Entertainment Inc)(Pure Marketing Solutions LLC) (Internet Matrix Technology )

Read the Stipulated Order ? Sections 4 & 5

Here is just a cut of a few things they must provide:
?A list that identifies every person who is marketing or promoting, through
commercial email messages, any goods or services of a Defendant since
entry of this Order;? ? U.S. mailers you are fucked, complaint or not.

?Accounting records that reflect revenue generated by sales to individuals
through an affiliate program and corresponding disbursements to participants
Defendant?s affiliate program on an individual basis, including copies
recently deposited check for each such participant paid by check;? ? The rest of us.

You should read everything they have to give up. And you should thank the companies that said NO to these agreements: (T.J. Web Productions LLC) (Cyberheat Inc.) (Impulse Media Group)

So the GOV can?t get a list of people to bust for 2257 because of the FSC, but now they have a list, a rather large list.

the only people that have something to fear it the spammers, and they pretty much dont care since most is set up outside the us

There will be a TON of irs fallout from this....this is how they will tie everything together....you are talking about a list of ALL affiliates of some pretty big proggies...AND COPIES OF THEIR LAST PAYMENTS!

Which may mean cancelled checks which have the individuals bank account #'s on them.....pretty easy to follow that info......bad times for the larger affiliates who promoted these programs......

I pay my company taxes on every dime I earn so I'm not worried.. Check, Wires, Epassport Payments, etc.. But I guess I can see were some webmasters should be worried. I do know of a few "smaller" guys that just pocket the money.. Looks like the IRS will be busy.

This is a common quote...but my accountant tells me...they can ALWAYS find something.....i do not know many folks who come through an audit totally unscathed.....maybe an auto lease mis-represented....maybe some entertainment over exempted...something is ALWAYS there......the drama of just sitting through an audit is enough to make you sick....

I'm not particularly worried. So the FTC has my address now, big deal. I'm not in violation of any 2257's, I don't mail and I'm paying my taxes. The IRS had this information anyways, so if there was any actions the FTC wanted to pursue, it just took a court order to the IRS to release it. They just simplified the process as far as I'm concerned.

Yup, I went through a 2 year federal investigation. Clean as could be. Had 2 accounting errors (we admitted to and paid for it), and too many business expenses related to travel. I thought they were all legit but hey, they'll find something to justify their time. It's not something I want to relive anytime soon.

I think the mailers are the only ones who have anything to worry about. Afterall, they are the reason for this whole FTC complaint. So the government has all our info now? Well if you live in the US and pay taxes, the government already has all your info anyways.

Been through an audit myself as well that lasted over a year. Learned real quick that tax law is a lot like California's OSHA saftey laws. If you comply with all of them you are bound to be breaking some of them. Ended up with a few small penalties, a years worth of headaches and some big bills for a tax attorney.

FTC will start an investigation on your company,it will request the info of your mailers and you won't pass them? yeah right
If you mailed in the past most likely FTC has already your info from past investigated companies.

Except that we eliminated mail from our program 6 months prior and had no active mailers in our program.

Many of the other companies are still accpeting mail.

We do not.

Like I said I can't say what others did.
