WASHINGTON ? The online adult industry faces another regulatory assault tomorrow when Sen. Blanche Lincoln rolls out a proposed federal legislation that would impose a 25 percent excise tax for all adult transactions.
The Democratic-led bill also would establish a child protection trust fund financed by the excise tax and place new requirements for age verification on websites and billing companies.

A press conference is scheduled for 11 a.m. (EST) Wednesday to introduce the proposed Internet Safety and Child Protection Act, which coincides with the release of a new report on the online adult business by Third Way, a think tank and advocacy group.

Lincoln, in a release obtained by XBiz, said her legislation would help relieve the anxieties experienced by families due to the lack of controls they have over what their children view online.

She also said that it is time the costs of protecting children online shift from the American taxpayer to the actual purveyors of online porn.

Lincoln plans to make the Wednesday announcement with supporting Sens. Tom Carper, D-Del.; Mark Pryor, D-Ark; Mary Landrieu, D-La.; Joe Lieberman, D-Conn.; Debbie Stabenow, D-Mich.; and Ken Salazar, D-Colo.; as well as Rep. Jim Matheson, D-Utah and Rep. Robert Menendez, D-N.J.

I know its not gonna happen but I wish they would actually get one of these bills out of committee - last few times theyve been killed there but wouldnt it be great for the US congress to legitimize porn as an industry The part about the warning pages has already been shot down by the Supreme Court (called CDA) earlier this year - but that tax would be fantastic

Democrats proposing taxes - Nothing new here. The singled out the adult industry on this one because they would have no public opposition, they really want to put this tax on all industry.


Dont worry guys, The conservatives will save you from more taxation. Always have, always will.

Thats the good thing about liberals loosing power in all three branches of the government, you dont have to worry about crazy taxes killing your business in the name of social programs.

More importantly - to use Third Way reports as your basis is the best way to get laughed out of Congress - they are an advocacy group that is trying to battle conservatives by molding a new group called "progressives" - a bunch of former "liberals" that are trying to take the south back for the Democratic Party.

And finally the Congress is already working on a bill that adds two more years to the prohibition of taxes on the internet 47 U.S.C. 151 - the bill is H. R. 1685

Just to clear up some misconceptions - bills get introduced every day that dont even make it to a committee let alone to a full vote of the house or representatives - you really ought to look at the bill they introduced earlier this year - it abolishes the IRS and gets rid of the income tax system completely and replaces it with a flat tax - and its still around - H.R. 25 and the Senates version S. 25
Now there's something I would vote for

All of this grandstanding by congressmen (and I guess women in this case) is usually just to grab attention to their cause - which in this case happens to be "furthuring the attention to the progressives stand in preparation for the 2008 election.

Thats a pretty good post. A few years ago liberals realized that "liberal" was a bad word with the American public and decided they needed a makeover. They changed their name to "progressive" and started calling themselves "moderates".

As far as the south is concerned, they may be to late. The south has always been traditionally democrat because the people didn't care to get educated. They voted democrat because their fathers and their fathers voted democrat. Many self proclaimed southern democrats realized that they actually had conservative values.

The last two elections were highly publicized and forced southerners to learn about the issues. Gore and Kerry were the worst case scenerio for the democratic party to relate to the south. Gore didn't even win his own southern state.

I already pay taxes. You think an ADDITIONAL tax on porn will stop those who want to make porn illegal? You think the likes of Ashcroft and Gonzales will stop because of a 25% tax? No way.

I don't think this is so much about taxes. Taxing something is a great way to reduce it. Yet another attack on the industry under the guise of protecting children. What Senator or Congressman can vote against such things? It's very difficult.

Fortunately, the system is greater than the sum of its parts. The Supreme Court has done a good job of knocking down such laws as CDA when the time came.

Yes the tax would be legal and hold up in the courts if it is passed, but the age verification portion is something the courts have struck down again and again, so if this were to be signed into law we would have injunctive relief from the courts very quickly.

Moderates are not the same as liberals. If I had to place a current political label on myself it would fall more toward moderate. I do not agree with many things in the "liberal agenda" but I am certainly miles further from conservative.

Good thing about it is that they named it an excise tax in the bill - that means the consumer has to pay it - similar to the tax added to the sale of gasoline.

Also noted that the CEO of Vivid was on MSNBC coutering the whole thing this morning - and they actually allowed him to say what was important - that we already do check the ages by requiring the use of CCs to enter a site

credit card verification to check ones age is illegal according to the credit card association rules. i didnt see the interview but i hope he didn't make it sound that way.

any online business (mainstream or adult) can only hope and assume the person on the other end making a cc purchase is of age but having a cc does not mean you are of age.

Cassie - the CC thing has been brought up many times over the last 9 years - and it has always been used to the biz's advantage - going back to the AVS's and all other attempts at CDA's that the gov't has tried. Fortunately it has never really been used as a legal defense to my knowledge as the EFF and others that file the suits against the CDA's were always able to get them thrown out of free speech grounds.

If my memory serves right it stems from the old phone sex biz when kids used to rack up hundreds/thousands of dollars on phones - the biz had to go to CCs as proof that they were "of age".

I do agree with you, however the reality is that the CCs have been thrown up as a defense frequently as the "age check".
Personally my opinion is that this all just another little hoopla like the 12 other attempts that congressmen have tried to do the same thing over the last 5 years - the bill gets introduced - it goes to committee and gets put away.
Ive said it before - but there is no congressman in their right mind that is going to legitimize this industry by voting for a tax on it.
Secondly - there is a bill that has already gone through the house and is in the senate right now that prohibits any taxes on the internet for another 2 years - the law right now states that you cannot tax "services" on the internet.

Not sure how you would tease out the effect you speak of. Per capita alcohol consumption is down in the US the past 20 years. Smoking is down too. Now I would say that is mostly due to cultural/health changes. Less people are smoking though. Due to taxes? Maybe. Maybe not. Here is what happened in Oregon in just two years in the late 1990s though. A 10% tax was followed by a 10% drop in consumption.

This is pretty true. Every "redneck" and farmer I knew growing up was Democrat due to subsidies and other similar programs. They do not vote Republican because Republicans are behind the larger farming corporations that push a lot of the regular farmers out of business.

My uncle is the only Republican farmer I've ever known, and a lot of that is based off of his religious morals.
