You should say, "If you run an affiliate program BASED IN THE USA, you're fucked". Plenty of good programs are located in Canada, Australia, and beyond.

Thanks. The way I read this, the company could simply refuse to accept ANY mailer traffic and terminate anyone who sends them any. This would deter spammers from signing up and would give the company a leg to stand on in future cases like the one in the article. I could be wrong though, I'm no lawyer.
