Yep, guess programs will have to pay attention to their traffic sources and not accept mail traffic.

which really sucks for some people. I hope the mailers have been saving for this day and have moved on to pushing cialis, mortages and Fake Rolex.

You should say, "If you run an affiliate program BASED IN THE USA, you're fucked". Plenty of good programs are located in Canada, Australia, and beyond.

Plus, the larger companies like Bangbros will just pay the fines and keep on rollin'.

Thanks. The way I read this, the company could simply refuse to accept ANY mailer traffic and terminate anyone who sends them any. This would deter spammers from signing up and would give the company a leg to stand on in future cases like the one in the article. I could be wrong though, I'm no lawyer.

But why didn?t the FTC simply target the offending spammers directly instead of the affiliate programs?

?We have gone after spammers in the past,? Kraden said. ?One of the main functions of this was with a top-down approach.? By bringing action against the affiliate companies ?under the theory of liability,? Kraden said the FTC hoped to ?get the attention of the industry and help bring the industry under compliance with CAN SPAM.?
Okay, so according to this law if I'm a mean competitor, I just sign up for an affiliate account with one of my main rivals and spam like a mofo ... knowing they will be on the hook and likely not me?

This is gonna open up a can of worms. It's trying to hold someone responsible for the actions of someone else who had no knowledge of their actions.

give me a break- spammers know who accepts and who does not and we have not had a rogue in over a year. the word spreads and no worries for those who are zero mail traffic.
