Canada has some of the most "progressive" laws relating to common law relationships in the world.

Basically if you are co-habitating for 6 months you are married under the law. You can fight it in court, but the judges here are
generally biased towards the women and you may end up paying alimony forever. Even a pre-nup is not always applicable in Canada...your spouse can go before the court and say that it is unreasonable and the court may "re-interpret" the document.

When I got engaged my lawyer advised me to not even have the ring engraved with my name...or even to be in a photo together.

A lump sum payment and a count of your remaining blessings may be in order.

BTW are you in West Van? I always hear talk about some big shot webmaster up there :c)

I'd think the Canadian property laws however progressive wouldn't be much different than our divorce laws at worst. I do know that if you can prove you had something going into a marriage a spouse isn't entitled to it in a divorce or if something was specifically given to you, it's yours.

Examples would be if I'd been running a business at a certain income level before getting married. None of my money problems with my ex would have meant a thing in the courts if I'd not started the biz while we were married. It would of been mine going in and mine coming out. Same thing with a home or other property. If it was yours going in, it's normally yours coming out.

You have to be living together for 3 years to be considered common law spouses (unless a baby is born). Common law does recognize some spousel support obligations but not nearly as much as lawfully married spouses (no 50/50 split on divorce).

The Family Law Act of 1986 does not apply, I suggest you get a better lawyer.

PK, we had that in Canada until 1986. Before it was only "family assets" now it's "net family property" which is pretty much everything.

Sell all of your properties to your brother or form a corp to hold them , then file for bankrupcy (personal) and then ask the judge for a share of money from her monthly income, make it go backwards on her, I'm sure that will make her run the other way around :winkwink:

Let her know that if she does this -- this is war. This is an act of aggression on her part. If she is going to fuck you in the ass -- she can't expect you to take it lightly... From now forward she is your *enemy*... use your resources creatively to discredit her any way you can... then fuck with her sources of income, transportation, etc...

Man.. I thought I had it bad. I don't have the massive amounts of cash you guys do, but I'm in a bullshit situation with the only girlfriend I really ever had/cared about.

About 9 months ago, I lost my job. I was working for $50k/yr doing bullshit linux/perl stuff at some bullshit corporate 9-5 job. You all know how the economy fared for tech workers, especially ones with less than 4 years experience in the field. Things were allready rough before that, just fighting a lot, as she'd get pissed over EVERYTHING. I mean shit, I'd stay at work an extra half hour to get some shit done, and she'd not talk to me for a day or two. Or I'd grab the wrong kind of whatever product from the store for her, etc. Just general immature fucking bullshit. I should note, that we do have a kid. Great little guy, 9 1/2 month old angel who is loads of fun to be around, the only thing keeping me going right now.

Anyways, I digress.

So, I lose my job. I was expecting her to fly off the handle, which she actually didn't right away. I think she figured I'd be working the next day since the year or so before that I had to practically fight off recruiters with a stick. After about 3 months being out of work, she started the nagging of "why don't you get a job". No matter HOW many times I explained to her I'm making double the money working at home on freelance stuff and my fledging adult "career", she'd still get pissed and tell me to get a $7/hr bullshit deadend job. Finally I said fuck it, and was going to. But wait, now she said I couldn't because she didn't have anyone else to watch the baby during the day.. I loved having the skills/etc. neccessary to both be home all day watching the kid, and also making (barely) enough to pay the bills and such. But, I'd constantly get the "I'm at work 8 hours a day, and you just sit on your ass in front of the computer doing nothing" thing. This is coming from a girl who fucking lives at home with her parents, has hardly any bills, and any that she does have are paid by me (her $150/mo rent she pays her mom, her cell phone bill, and just baby stuff).

Argh.. Anyways. :) 3 months ago she's like "I need my space" and kept going back and forth whether we were "together" or not. I was cool with this, I needed space too from her suffocating ass, but I still loved her quite a lot. I figured it was just us not getting along very well. But, find out 5 days ago she's pretty much dating some fucking security guard from the store she works, and is a FUCKLOAD closer to him than she had told me. I was fine with her going out to dinner with random guys and such, to make sure of what she wanted. But she wanted to leave me because she was interested in this guy.

The last 5 days have been hell. Havn't eaten since then, and barely slept. Can't get shit for work done.. Not sure what the fuck I'm going to do about bills. I fucking dealt with so much of her bullshit, with promises from both her and her family that she'd get better at dealing with conflict/etc. and things would get better.

Then she says she's going to take me to court, and such for child support, and get "back" child support even though I've spent thousands since she got pregnant. I seriously thought I'd eventually marry this girl.

Oh well, fun stuff dealing with the gammot of rage/betrayal/sadness/etc. all at once. Not sure where life will go next, but I'm not very upbeat.

Strange how you can tell complete strangers on a board somewhere shit like this, when I have absolutely no one to talk to in real life. Sigh.
