I wasn't interested then, and I am not interested now.
|
Here I will quote myself...
Quote:
Now FTP... You know that MPEG did not break all 5 but the exhistance of its Patents invalidated some of Acacia's and some elements of the MPEG Foundations Patents were used in court. Right? Or am I wrong? |
FTP now go back and figure out why FarL has decided to attack me?
I have been defending myself from this guy for quite some time and his retarded attacks just get weaker. It may not be appropriate to call em a fuck face but I didnt start it. FarL chose to start it. Why? Because I am Ex CE? He has issues. I have no problem pointing out how retarded he is at this point. |

unfortunately it doesn't work that way, if it did, M$ would be a defendant right now and there is also that tiny print in EULA. It was fairly recently that M$ said it would step in to help any company that was using their products against a patent infringement case.. but so far, has only been talk as far as i know. A patent holder can go after people who use the product, rather than the company that made the "infringing" product. it's called contributory infringement. Acacia was even trying to go after companies that LINKED to video on a different server. they were citing that the website was "contributing infringement". to one webmaster, they told him to remove a link for an image that pointed to windows media player. it was all quite absurd back then as they tried everything they could do trick webmasters into paying, they claimed that downloading any audio from a webserver was included, but when digging down into the details of the patent, MP3 audio format was not covered because their patent described "timecodes" which exist in MPEG/QT/WM/RM files.. but that didn't stop them from tapping some companies. Fight the Patent! |

wrong. Fight the short answers! |
Thanks for clarifying that FTP.
If I can find the email address I sent from and sent to I would post it. Still rifling. |
So you say this:
"they claimed that downloading any audio from a webserver was included, but when digging down into the details of the patent, MP3 audio format was not covered because their patent described "timecodes" which exist in MPEG/QT/WM/RM files.. but that didn't stop them from tapping some companies." Then say they MPEGS patents were not used to fight acacia in court? I think you are getting confused. |
I would love to see the court transcripts.
I find it very hard to believe that MPEG Foundation patents were not used in the court room. |

the "attacking'" from far-l seems to be based on the facts that in mutiple threads, you have brought up that they eseentially were stupid in fighting acacia and bad businessmen.. that they should have just settled and continued on with business.. that CE had negotiated a license for them, etc, etc, etc. I do believe that you feel the patent is bogus, and i do believe you have spoken your convictions to others.. but your support for CE in the case vs. homegrown video spilled over into the acacia issue.. which are 2 different issues. Fight the Apples and Oranges! |
Fight The Interview!!!
Sorry I used your trademark FTP. :1orglaugh Here's that historic interview I did with Robert Berman from Acacia. The very beginning got clipped from the archive, but you can hear most of it. http://d-moneyshow.com/archives_live...ly29_2003.html "Low Hanging Fruit". I believe he also said the word "bullshit". Which is pretty uncommon for a representative of a public company to say in an interview. Enjoy. |

from my recollection, there is no such thing.. there hasn't been any "court" time per-se like a jury trial. the Markman hearing was to define words, which mpeg was not brought up. Judge Ware specifically told both sides he didn't want to bring up technology, he wanted Acacia to just clarify its definitions. Any codec could be used for the digitizing and compression parts.. and does not invalidate the claims, unless you can prove the other steps. MPEG video files were not around on BBS back before 1990 because MPEG was still in its very early infancy growth. Fight the memory! |
"but your support for CE in the case vs. homegrown video spilled over into the acacia issue.."
I did not confuse the two. FarL bonded them together and lumped me in. Business wise. FarL did have a free ticket. Kinda stupid to piss it away IMHO. Business wise speaking. Which leads me to say... He hit a Home run and struck out at the same time. Its just silly business manuevering. |
Quote:
Your right. It was just Markman. I suppose they would not use MPEG during that process. Why not go all the way to invalidate them? IMPA has the Nail and the Hammer. |
Quote:
Statements like that are venomous poison and an outright lie. And to Answer FarL is simply. No Just you FarL are stupid and I still feel it was a bad decision to piss on a free ticket regarding Acacia. Sure ya did a cool thing and all but it was still a bad business decision at the end of the day. |
Quote:
by viewing the video, you are using the wonderful, innovative, and pioneering technology that Yurt and Brown conceived back in 1990 when the filed their patent, which acacia subsequently bought. If it weren't for these two, the video link that D$ provided wouldn't be possible... ....ya, right if you believed Berman and Acacia :321GFY video was on amigas and macs well before Yurt & Brown.. but i don't blame them, no one does what their patent really says.. it's acacia that came up with the pipe dream of what they WANT it to mean. D$ is the biggest infringer of my patent on signing tagline with "Fight the..." keep it up, and you;ll be D- (D minus) from the royalty payments. LOL Fight the game! |
Quote:
getting a non-infringement verdict is easier than invalidating the patent. with prior art, the claims of infringement can be knocked down, and the defendants will be off the hook, but the patent would still be valid, just not applicable to anyone because the terms and scope that acacia claimed were knocked down. this would mean ALL internet websites would not have to worry about acacia, but those that signed with them, would have to continue to pay, because the contract reads about termination if patent is not found to be valid... non-infringement does not trigger that provisional clause. Fight the license royalty increases! |
So I guess the proper question or thread title is...
"Who is still paying acacia?" |
Quote:
given that the license is until 2011 when the patent expires, the answer is the same as the answers to the thread title. Fight the end of the world! |
Quote:
Does anyone have a link to the thread where Alien got fired? |
Quote:
God damn this is impossible. The agony of dealing with you fucken retards I swear it fucken hurts. |
Dig420...
I was not fired from CE. I walked and left by my own accord and decisions. Dig420 I see you want to find the company I was fired from. That company would be Vivid's Internet Divsion. Ok Dig420. Technically it was not a firing it was a breach of confidence resulting in me leaving. But I must admit I was not happy about being there in the first place. Now I know you are not curious really Dig420 about why or how it happened. But yes the thread is right here on GFY. You can find it ya big boy... Dig420 I know it must be hard to deal with your fucked up mind. But please... can you try and be a little more intelligent or just smile? Dig420 a smile is always nice. You can be a total idiot and no one would ever know. Dig420 I think that is your best option these days. |
lol loosers

Your the man! :1orglaugh Doesnt matter if it was used or not... What ya said was another incredulous and venomous lie about me. I put up info and gathered some though and was quite vocal about Acacia and its false claims... Tisk tisk... Fucken ingrate. |
Quote:
The day you recognize that will be the day I let up on you. |
Quote:
|
"CE is just one more place that you got fired from.. not terribly important."
Is that so? Were you there? LOL. No. I was not fired from CE. I walked off. Infact I am one of the Very very VERY few if not the only that was offered a ticket to go back. I almost took it but my own business is fine enough for me. It must pain you to know I get along fine with everyone over at CE. To this day. Lossin traffic, no more promo platform, no free ticket, less money. Now you know what it is to fend for yourself. It must be painful for you. |
AlienQ: Good for you. Can you please say what you bring to this thread since once again you have no clue and no stake in this whatsoever.
|
Quote:
Making a lie about me supporting Acacia. Once again you are untrue... |
Quote:
Only you made the bad decision. Your the idiot. And yeah your fight with CE is stupid. Sorry. It just is. Collect the facts. Ya had a free ticket. All you had to do was collect a check and get laid once in a while. Damn tough life! LOL! |
Quote:
Goof. We were the biggest breadwinner by far in that program and it turns out it was their most successful program. Free Ticket? Less money? Fend for ourselves? We were fending for ourselves from day one. Making more money from the first day they dropped us. And none of it was free... in fact we are still paying the price for dealing with them. Now can you please keep this thread on the other topic you know zero about? |
Quote:
You can do it... I am sure you can.... But you wont. You love my cock. |
Quote:
This is about Acacia... not you... not me... not CE... get with the program. |
Ghee FarL if that were so...
Maybe ya should refrain from using my name and matching it with lies. I have said nothing untrue in this thread. But I love the rhetoric of misinformation about me. I can not help but be attracted to it. I stated a fact. I opposed Acacia long before you even got the god damn paperwork with the words "Acacia" on it. When you were scratching your head wondering what it meant I explained it alot in black and white terms. Right here on GFY. Infact I even bagged on a number of companies that signed with Acacia. :1orglaugh |
You are high.
Say one meaningful thing about Acacia. You make claims but back it up only with hot air and pure hubris. I am not calling you a liar. I am calling you a fool to assume that you knew about this before anyone else. And you are an idiot to assume that you know anything about it now. |
Quote:
:1orglaugh Peoples under-estimation of me is my best trait. But go on and tell yourself whatever makes you rest easier. Peace fuck head. |
AlienQ,
I usually don't put people on my ignore list unless they post ******* or other 'shit'. But I will make an exception in your case. You really don't know how to hold rational conversation. |
Far-l, alienq is not worth the time, just let the thread die, he enjoys this shit too much and its like arguing with a brick well, instead, send me a pass to homegrownvideo, i love it !! haha :)
|
Quote:
Whats Microsoft doing now regarding Acacia? Same thing I told ya 2 years ago or somthing. Nothing. :1orglaugh It's OK, man put me on ignore. Please do I mean it kinda sucks to see that what I have pointed out and my side regarding Acacia is in agreement in oppostion. Acacia was shit to begin with. Duh. No brainer. Everything else is just the pieces falling into place. I can give to fucks about attornies to duke it out. I just know shit when I see it. Sure any information I provided was not used huh? Awright... Whatever... I can not prove otherwise really since I can not find emails I sent nearly 2 or 3 years ago. But ya know go on... Pat yourselves on the backs and suck it all up as hero's of the internet, I been in agreement in defeating Acacia the whole way. Kick ass man but to say I supported Acacia. Thats just nuts. Fucken ingrates... |
Chris from ATKindgom notified me that they are part of the Defense Group in the fight against Acacia.
Note that ATkingdom was not sued by Acacia, and is one of several companies that are part of the Defense Group that aren't defendants. Some companies did not want to be made public. ATKingdom wanted to publicaly show their support for the companies in the fight, and had no problem having their name be known as being a financial contributor to the Defense Group. :thumbsup Fight the ACTG! |
did this stupid topic really have to be posted on very board charly? come on now dude.
|
Quote:
People don't realize that these are problems that continue to plague our industry and set a precedent for the future. I for one thank Charly for not letting people forget what is happening or what has happened so far. Remember... "without eternal vigilence it can happen here" |
