A patent holder can go after people who use the product, rather than the company that made the "infringing" product. it's called contributory infringement.

Acacia was even trying to go after companies that LINKED to video on a different server. they were citing that the website was "contributing infringement".

to one webmaster, they told him to remove a link for an image that pointed to windows media player. it was all quite absurd back then as they tried everything they could do trick webmasters into paying,

they claimed that downloading any audio from a webserver was included, but when digging down into the details of the patent, MP3 audio format was not covered because their patent described "timecodes" which exist in MPEG/QT/WM/RM files.. but that didn't stop them from tapping some companies.

the "attacking'" from far-l seems to be based on the facts that in mutiple threads, you have brought up that they eseentially were stupid in fighting acacia and bad businessmen.. that they should have just settled and continued on with business.. that CE had negotiated a license for them, etc, etc, etc.

I do believe that you feel the patent is bogus, and i do believe you have spoken your convictions to others.. but your support for CE in the case vs. homegrown video spilled over into the acacia issue.. which are 2 different issues.

from my recollection, there is no such thing.. there hasn't been any "court" time per-se like a jury trial. the Markman hearing was to define words, which mpeg was not brought up.

Judge Ware specifically told both sides he didn't want to bring up technology, he wanted Acacia to just clarify its definitions.

Any codec could be used for the digitizing and compression parts.. and does not invalidate the claims, unless you can prove the other steps.

MPEG video files were not around on BBS back before 1990 because MPEG was still in its very early infancy growth.

getting a non-infringement verdict is easier than invalidating the patent.

with prior art, the claims of infringement can be knocked down, and the defendants will be off the hook, but the patent would still be valid, just not applicable to anyone because the terms and scope that acacia claimed were knocked down.

this would mean ALL internet websites would not have to worry about acacia, but those that signed with them, would have to continue to pay, because the contract reads about termination if patent is not found to be valid... non-infringement does not trigger that provisional clause.

Chris from ATKindgom notified me that they are part of the Defense Group in the fight against Acacia.

Note that ATkingdom was not sued by Acacia, and is one of several companies that are part of the Defense Group that aren't defendants.

Some companies did not want to be made public. ATKingdom wanted to publicaly show their support for the companies in the fight, and had no problem having their name be known as being a financial contributor to the Defense Group.
