Can it be illegal to link to a site?

Think about this:

I have someone linking to www.mrthumbs.com (not my site but just an example).

And i dont want this fucker to link to me... is there anything i can do?

Second example:
I have someone linking to www.mrthumbs.com (not my site but just an example) and mrthumbs is a trademark.. is there anything we can do then
since he included a trademarked name on his website (part of the url?).

Third more practical example:

Someone created an affiliate program and linked several high profile companies and sponsors without a ref link making it look like they are
A. affiliated or B. advertisers of the site.

And im one of them and want my link of his site but he says i shouldnt complain because its 'free advertising'.

Traffic is already redirected to a page from php with a quick explanation this person is a scammer. (doesnt seem to bother him).

But it did make me think about the subject.. i could setup any type of shop and
claim affiliation with any big player and theres nothing they can do about it. Hmm..
