Are USA adult dating sites as good as gone with 2257?

Just wondering since I don't see how they could comply with 2257. The dating sponsors I use have graphic photos on them.

No. Sites will hundres of thousands of users will not be liable just because some of their users don't comply with the rules. It depends whether or not they can "reasonably" manage the photos. If they cannot, then they are exempt from the law:

(4) Producer does not include persons whose activities relating to the visual depiction of actual sexually explicit conduct are limited to the following:

(i) Photo or film processing, including digitization of previously existing visual depictions, as part of a commercial enterprise, with no other commercial interest in the sexually explicit material, printing, and video duplicators;

(ii) Mere distribution;

(iii) Any activity, other than those activities identified in
paragraphs (c) (1) and (2) of this section, that does not involve the hiring, contracting for, managing, or otherwise arranging for the participation of the depicted performers;

(iv) A provider of web-hosting services who does not, and
reasonably cannot, manage the sexually explicit content of the computer site or service; or

(v) A provider of an electronic communication service or remote computing service who does not, and reasonably cannot, manage the sexually explicit content of the computer site or service.


Look at "v" above.

If the dating site just blindly posts any photo submitted, this may cover them. However, if they review and approve/reject the photos, as most dating sites do, the site IS managing the photo content and this aren't exempted.

AFF refused my picture because I was sitting naked on a horse in Jamaica

So they are checking each pictures. Today I went into my AFF account (hey gotta have some fun eh?) and there are thousands of hardcore pictures. I am soo going to check them out on June 24th

I've been asking this same question for a month now. So far, haven't received any answers. If I was an affiliate of AFF or any of the other dating sites, I would be demanding an answer. If they do have to keep records on hand, this means each member will have to willingly provide a copy of their ID. This could and would have serious implications on the membership sales. (and corresponding commissions).

I'd be steaming mad if anyone providing an income to me was being closed mouthed about such an important issue.

If they manually moderate the pictures then they will probably have to comply with the regulations just like everyone else.

If they allow their members to change the photos without any moderation anytime they want to, then their lawyer would have to decide what "reasonably" means to them.
