I could tell just by the tone of Duke's statement that this came at long and hard thought, and he didn't take this decision lightly.

It does suck, and I've been content, so I know how scary it is to think that total strangers have access to my personal information; to the home where me and three kids sleep at night. But I knew when I posed that it was a possibility. I don't think I grasped the full scope of the possibility, but still, I knew.

Anyway, I guess my point is that I think the blame for placing these girls at risk belongs on the lawmakers, not the people trying to abide by the law.

Good to see someone finally understands that some of the people offering models ids (such as Duke and his extremely hardcore program) really don't have a choice to not offer them.

I'd just like to add that this was a decision we thought long an hard about. We were in close contact with our attorneys before any decision was made. We spoke about this for quite a while and slept on it for many days... This was our conclusion and we are more than willing to stick to it, continue business as usual and screen affiliates a little closer.

Sure it would be easy to hire in house people to submit, promote, etc... But we have built up a strong affiliate program and I know that we'd have many disappointed affiliates if we closed shop. We love working with our affiliates and we don't wish to end that relationship, so a decision had to be made. Just be assured that we're not giving this sensitive information to any Joe Blow off the street.

Regardless of whether you agree or don't agree, please respect our decision and know that this is not something we decided without plenty of thought. This was a law enacted by the US Government and we are only trying to be compliant. We are each to read the law and come up with our own conclusions...this is ours. While it's the easy thing to point the finger and say that we don't care, you couldn't be further from the truth. Point the finger at the government and their lack of consideration for the models involved in this industry. remember... This effects the male talent just as much as the female pool. There is no easy decision.

FSC is doing that (or trying to) currently. We are members of the FSC. We are doing our part as a company to fight this assanine law, but there is only so much we can do at this time. I can't comment for Duke, but I think that at this time since there has been nothing to base the law on (previous prosecutions, etc), and there aren't a lot of lawyers who would want to be the first to challenge this. The time alone that it would take would halt our business to the point where our productivity would be severly hindered.

As an industry, our only hope would be as KRL said: That we can watch the lawsuits fly, convincing the lawmakers that this law is complete bullshit.

Anyways, this is a hard decision that we had to make. At this time, we found this to be the best way to handle things and until we are told different, our stance will remain as it is.

hey, i don't expect you to change but what's right is right, & wrong is wrong & any court will show that this is WRONG. your attorney will tell you the best thing for you as an individual company because you ARE a business. he wants to protect you & your money. he is less concerned about the privacy rights that r being violated when you "comply". its a selfish world... loads of cats will do the same thing. but think about this:

While I dont agree with giving out models ID's I do totally respect the hoops you will jump through to make sure you are giving them only to responsible affiliates. I know its a tough desicion and I do respect the time and care you took in making yours.

For what its worth, I think you did the right thing based on your hardcore business model.

I have two first ammendant attornies that i use. Both have different takes on it. In all honesty, i feel more comfortable giving out sanataized docs but keeping the originals myself.

me personally? no... i'm not giving out shit & i don't have to because i don't run a program that requires people to use hardcore material to advertise. am i standing on the sidelines? no... because i do run a links directory that advertises using banners that include explicit images. am i taking them down? fuck no.... why? cuz its bullshit for them to try to say i need to have access to those sensitive documents to use the images for advertising ONLY.
