I mean you already KNOW if your content is "sexually explicit" or not now don't you? It's is for 99% of us.

Knowing this you KNOW you have to have the proper docs. Primary prodcucers have had to deal with these docs for YEARS now so all you need to do is get a copy of the docs from them. It's not like you've got to go out and find the chick yourself and get the shit from her.

In addition to the info on the docs the DOJ wants to know WHERE this content is located. YOU made the sites, pages, galleries. YOU should fucking know where the content is.

The DOJ has a specific way they want you to list the info in your files and I'm not getting into that, just read the regs. It states which order the info should be listed and how it should be referenced.

Also the DOJ wants to know where to find the "custodian of records". This is YOU. You can rationalize all you want that you're not REALLY a 2ndary prodcuer or you are only a "distributer" or you shouldn't have to be the "custodian" but the according to the DOJ you are a 2ndary producer and you are the "custodian of records" for content on your site. Thus it's YOUR name and address they want on the 2257 page so they know where to do an inspection. Now if you work out of your home and you don't want to list your home address then I suggests getting some office space somewhere.

Bingo.

The new regs do little for practical purposes. It isn't about recordkeeping, its about hassling adult webmasters. As a smaller webmaster, of course I'd be irritated if I have to waste more time with red tape that I could otherwise be developing and promoting sites with.

no need to stress over what you can't change, and since there is little we can do to change the 2257 (besides supporting the FSC) like any business you have to be able to adapt.

It's easier just to assume you HAVE to comply than to try to read into the rule what you WANT to read into it. Trying to find some loophole to get of doing this will only cause you trouble. Let the lawyers find the loopholes and until a court says "No you are not a 2ndary prodcuer" safest best is to comply. Worst case scenario is you did a lot of work for nothing. Beats jail time.

95% of all regulations in all businesses are BS red tape. And yes these rules are just to get as many of use to quit as they can. They rather have 1000 of us to just quit than to throw 1000 of us in prison.

Of course it is but if you have been shooting your own content you've had to do this anyways. If you haven't well this is the price we pay to do this for a living. If you are afraid or ashamed to list your name and address then you don't have much choice but to find another way of making a living. At least office space is a tax deduction. Every business in my town has to have a business license( which is a BS rule in itself. License just means TAX. ). Through that I can find the name of the owner and their address through the public records.

I know. Thanks God I promoted revshare and built up a decent nest of rebillers, instead of going pps. I'll be living off of those rebills for a while.

He probally doesn't. Still doesn't mean he's not breaking the law. A UK farmer can't sell beef that not labeled properly in the US and according to the DOJ this falls under the SAME rules. These aren't MY interpretations, it's the DOJ's.

Thats not the case with internet commerce though. If he's a UK based individual/corp., hosted in the UK, then that doesn't mean he's selling in the US. There is a difference between selling in the US and selling to people in the US - if I, as an American, go to his site and buy porn, then that makes me an importer of it.. The fact that he is the passive party means that he's not selling within US jurisdiction, although the US can bar its residents from buying porn from the UK.
