I'm no lawyer, nor am I a content producer but I do know that as it sits the current 2257 law seems to violate some right to privacy laws. For example: if I go to work for a company that company will take down my information, including a copy of my drivers license or ID for thier records, taxes etc. But they can't just give it to everyone that buys the product the company makes. Same with credit card companies, insurance companies, doctors, pretty much anyone you give copies of ID to these days is forced to give you a copy of thier privacy policy. So I can't see how a court would let anyone with $30 buy some pics and get a models private information. Forget stalking Identity theft is now the #1 crime in America. Having your ID info availible to anyone with the money to buy a pic set seems a little wrong.
But then again, as I said, I'm not a lawyer. |

Violations of Privacy!
We have spoken to three Attorneys on this subject.
To the best of our ability we have found four Federal regulations that a producer MUST violate to comply with this new ruling. Producers MUST violate the following: 1. Freedom of information act 2. Personal Privacy Laws 3. Anti Stalking Laws 4. Releasing of pertinent personal information with the intent to do harm We are firm believers that PRIVACY must be kept safe - thus said how do you do it in this environment? ? Producer is going to really have to watch who they licensed content to. ? Producers are going to have to inform talent of the new rules and make sure the talent acknowledges that they understand them new rules. ? Producers MUST do everything within their power to protect talents personal data. We have a client that has decided to enclose edited copies of Identification and a text file outlining the pertinent details to each production. They are then using our software were buy the can offer clients / webmasters secure real time presentation of needed documents within moments of request. They will offer their clients the ability to log onto a secure site and recover the needed documents once they have proven their identity or needs to our client. This ensures that the receiver of the information is NOTY just some stalker who bought a single $6.00 photo set to get a girls personal information. Ask yourself if a stalker injures or worse yet kills a model based on a producer freely giving away the information whose will be sued? The producer or the Federal Government? These are scary times for the industry and avoiding these new rules will NOT save you. Action MUST be taken by ALL producers and secondary producers to ensure they are compliant in the next 30 days. |
