If I Plead Guilty..

to a law that is overturned becasue it is illegal, will my guilty conviction be overturned?

I am disputing a speed limit on a street that I was going 33 in a 20mph zone. But, Texas law states that residential streets cannot be less than 30 mph unless a "traffic engineering study" has been done, which according to the police officers, it hasnt been (but the law was changed in 1973, so they dont know if one was done then)

So, ive plead No contest to the charge, because my court date was sooner than I thought, and I havent been able to locate the study (but I cant prove that it wasnt done yet) Will I be able to get that removed from my record if the speed limit is overturned?

honestly I dont think so - some legal arguement would be that it is legal from the day it went into existence not back date all prior enfridgments.

The best thing you can do, is find the officer before court, and give him a sob story. Tell him that you dont have the cash to pay the fines. Smile and be nice. Beg if you have to. If he is not in the room at the time the citation is called, it is usually dismissed for lack of prosecution. Or he may stand up, and say that he does not remember the event. If he does that for you. Buy him a coffee the next time you see him. Let him know that you are not a bad person, and you just fucked up.

Why take the points when you don't have to.

Talk to the prosecuter on the day of your trial. Towns want money they don't give a shit as much about the offense. If you have a clean license let the prosecuter know this. Ask them to dismiss the entire charge. Chances are they will say no but start there. 9 times out of 10 they will make it a non moving violation. Insist that it is something that does not put points on your license.

... I just hate people that clearly have done something wrong and then try to outsmart the law. you've gone too fast, pay the fucking fine and move on.
