I think that if you think of a criminal and illegal crime (in other words an illegal action) then you have thought of an illegal act . . . a crime, and it should be considered criminal in nature and considered an actual crime (or an illegal act) and you should be prosecuted to the fullest extent of the law.

It is clear and obvious that all criminal crimes of an illegal nature that are active in your mind should be prosecuted as though you have committed the illegal crime of a criminal nature even if you claim that you weren't really thinking of the illegal criminal crime. Nobody really cares if you were thinking of the criminal crime of an illegal nature or not . . . you should be in jail and that is how it is. Thanks for asking such an insightful, deep qu3stion.

The answer really is not obvious. Or should everyone that thinks about killing someone be put in jail for conspiracy for murder?

You're dumb.

Lets have all murder mystery authors arrested and movie producers also. They saw a crime in their head and simulated it on film or paper. THEY ARE EVIL!

It happens all the time.. well.. for talking about something. You talk about selling drugs, kidnapping someone, killing someone, you go to jail. BS or no?

Half of the motion pictures out there would be grounds for prosecution.

That may answer the question.

This question did not come from reading 1984 though I have read it. It came from looking over past issues in regards to a recent local story about digitally created naked minors.
I do personally think that doing so is pretty sick and disturbing, I am not sure if it should be illegal.

Over here(The Netherlands) virtual kiddie porn is also illegal.

Any form of kiddieporn should be illegal, also virtual ones.

But you can't be seriously thinking about the thought crime concept.
In some places sextoys are illegal. You want to send someone to jail for thinking about or using a dildo?
