    Do Models need Model Release Forms???

    Hello,
    Please could you tell if its required by UK law for glamour models to sign a release form for every shoot that they do & do they need to be paid extra for signing a release form? I have some models i shot a couple of years ago and ive always thought that since they didnt sign a release form, i can not use their pics on anything commercial - Please advice

        You might as well burn those pictures before you get in trouble...Without a release you can't use them for anything.

                  I've never heard of girls being paid extra to sign a release.. If they want to get paid at all, they sign the damn thing. As for a copy of the release, technically they would be within their rights to ask for a copy (it IS a legal document and they have a right to know what they're signing.. especially concerning the personal information protection and privacy laws in the UK).

                  If the models have not signed a release, you are correct, you cannot use their images for anything commercial... well... for much of anything for that fact, EXCEPT perhaps your portfolio, and you would need their express written permission even for that. The model release generally establishes ownership of the images.. without one, the pictures basically belong to her (or at least her likeness does) and if you use them, you are asking for a HUGE legal problem. If the bitch won't sign a release, throw her ass out..there are 50 girls behind her who will sign it for no extra money.

                              Copyright laws in the UK

                              In the UK our copyright laws give the photographer full ownership. I gave Reggy links to the official information by email.

                              The only time the photographer does not own the copyright is when he is commissioned to do the shoot for a 3rd party. They then own the copyright. The other exception is when the photographer is an employee of the company he is doing the shoot for. The company then own the copyright.

                              In the UK and now the EU a model release isn't worth the paper it's printed on. A photographer can publish the result of any shoot where ever and when ever he likes. If he wants to sell them to a 3rd party in the States, then he needs to have all the details per your 2257.

                              I hope that clarifies the difference between UK/EU and US laws regarding copyright and publication.
