    What do you do if a collection agency is fucking with you

    Ok, off topic from adult shit, but I have a question maybe someone can help with.

    Like many people, I got in debt then lost my job and couldn't pay my bills (about 2 years ago). So, last summer I got back into the adult biz and started making cash again, which prompted me to rebuild my credit since I wasn't very far in the hole ($3k or so). I got in touch with one company handling one of my accounts, it is called 'NES of Ohio'. I paid them 70% as a 'buy out' option, and they were supposed to take care of it... this was in November.

    They never faxed any credit companies, or even send me a receipt. I called them about 3x now, and each time they said they sent one, but they'll resend. Last time I double checked the address they had, that was clear. Again, no receipt, nothing.

    So, I made a dispute on my credit report, and they investigated, and what they reported back to me was the 70% I paid was now off my report, but not as a paid in full like they promised. And to top it off, the remaining money has been building up interest again.

    What can I do? Should I call this company again? Should I call credit companies? Am I fucked? Any advice is cool, thanks!

      Make sure your payments go through your bank and are recorded , pay off the full debt , and dont fuck with them anymore its not worth the hassle most likely.

                              No, I said I wasn't very far in the hole which is why I tried to quickly pay off some of the debts with the buy out amounts offered by the scam collection agencies.

                                    1. You settled in full on the balance owed at 70%. You didnt Pay in full, BIG difference

                                    2. The company that you paid merely bought the debt from the original creditor. They can take all the time in the world to update your credit report since they are a 3rd party and not the original creditor. Even if they did that today it would only reflect "settled in full" not Paid in Full since you only settled.

                                    3. You will be liable to be taxed on the 30% that was "forgiven" when you paid the 70% settlement. You will get a 1099 form for the 30% that you pocketed from only settling out and not paying 100% in full. This 30% is viewed as income and taxed as such.

                                    4. Anytime you make a deal with a collection agency get the offer to settle in writing, pay them with trackable funds ( cashiers check, etc ) that you can have a copy of as proof that they we in fact paid as agreed. Then get a Settled in full or Paid in full letter where they acknowledge you did resolve your debt. You will need this letter since your credit report will probably never be updated by them and this will show the people that you are asking now for credit that you have indeed fulfilled the obligation as you agreed with the agency.

                                        I had sort of a similar experience, sort of. I had terminated service of a certain company years ago, and instead of terminating my account they up and sold it to a collection agency, then they pulled up stakes and moved their local offices down East.SOooo....

                                        After being bothered by said collection agency for six months (over what they said was an outstanding $2500), I went and hired me a good lawyer. Within about a month the collection agency backed off completely, the lawyer cost me $500 and that was that.

                                        I suggest you hire a lawyer to get this cleared up and your record expunged.

                                          I agree with CD. Hire an attorney. Collection agencies are bottom dwellers and they will tell you anything to get your last dime. In California, there is a very powerful State Credit Dept that kicks ass.

                                          I know of one Calif Collection Agency that had its license pulled for actions similar to what you are experiencing. NEVER make deals with collection agencies. Even though the creditor, for instance, Neiman Marcus, may have turned your account over to an agency, contact NM first and tell them your situation. It is worth a shot, even when they want to refer you back to the credit agency.

                                          Most attorneys will talk to you for free and even make a call or write a letter to help you. It's a good thing to have an attorney for a best friend.
