The Terri Schiavo fiasco and the legalities of oral contract.

The Terri Schiavo case is a typical case of an oral contract gone wrong.
The husband says that his wife told him that she wouldn't want to live like a vegetable. However, it is not in writting, but was done as an oral agreement between the husband and the wife.
Now let's say I have lunch with Bill Gates, and I come here and tell everyone that good ole Bill will give me a million dollar just for fun. What recourses do I have to enforce this "donation" since it was supposedly agreed to orally?
That may sound ridiculous, but the Schiavo case is the same, no written contract, typical case of "he said, she said", except that the "she" part can't talk anymore.
If there was a written contract, then I would have no problem with the hospital removing the tube, but in the current case, it sure looks like someone is trying all his might to silence another person

Well it's not exactly the same..
For hospital purposes, it's normal in lieu of written living wills to fall back on the communication you may have had in the past with your spouse. Not anyone else, your spouse, who becomes your legal gaurdian.

And I think it's a shame that all these politicians are using this as a chess game when it's a personal family matter.

Husband just turned down $10 million to sign over his gaurdianship to her parents. Money doesnt seem to be the issue. Perhaps a cigar is just a cigar here, and he's actually trying to comply with her wishes. Who knows. It's all fucked up and sad

unless it was put into writting by the wife her requests. A husband can decide either way despite what she may have told him or others.

My wife and I have talked about a case like this, if something happens to us, and we both agree to be disconnected so the other person can go on with their life. Don't tell me that I have to sign a contract before notary because our word is not good.

No you do not have to if you trust her. Though a living will and or a DNR in your medical records would greatly help.

First of all, you need to get your facts straight.
She is not on a ventilator, she breathes on her own.
She is not in a comatose state, she awakes and falls alseep and even yawns.
The only reason she is fed through a tube is that her husband does not want her to go through physical therapy to re-learn how to swallow liquids. Also note, that any body who breathes on their own have to swallow their own saliva by themselves, so she is not that far off from swallowing water and liquid food on her own.
As far as having other people clean your piss and shit, if we follow your thoughts, we might as well euthanize all paralyzed people.

DNR only applies in cases when somebody needs immediate ventilation or mechanical heart pumping, that's why it is called a "Do Not Rescucitate" order.

The husband already moved on to a new wife and has 2 children.

She's not living, she's existing, and that sucks.

If I were her, I'd want the tubes pulled and the whole thing over with.

I signed the DNR order for my dad, when he was terminally ill. It's not something you really enjoy by any means, but given the choice of being a vegetable or being at peace, who in their right mind would take the vegetable?

It is not the husband's right in this case.
He abandoned her, and most of us male here would do the same.
He's remarried and has kids.
Why is he so adamant about pulling the tube?
The parents told him, take the money and go on living your life.

let the woman die.. NOBODY in his right mind would like to live like that.. probably suffering everyday.. Her familly just cant let go and that is as selfish as it get...

Oh, very much so.
He waited 6 months to openly get with another woman.
That woman happened to be his mistress from when his wife was good.
He spent all the money that was won in a lawsuit and that was supposed supposed to be spent on his wife.
At this time his vegetative wife is a ward of the State of Florida and the $1.6 millions are gone
