I own a home with my brother. If he wants to use the 1040ez and take the standard deduction can I declare all the mortgage interest?

you can declare whatever you want, penalties are a bitch though.

logic tells me your entitled to claim half of the mortage interest, your brothers standard deduction technically covers the other half

Or sign up to TurboTax or the like and use the program for free to figure out what you can and can't do. You only have to pay when you submit / print.
