This, if real, really scares me a bit... and I've been around and through a few lawsuits. Only because I thumb some of galleries I choose, all surfer submitted. I was under the impression that absolut got shut down for making their own galleries. So are my thumbs illegal? They sure as shit can't tell me were to link to, but they can claim the thumbs as copyrighted images!

This is bullshit, thank God I have a few good lawers backing my ass up!

Those sites are all taken down for one reason: They built their own galleries and posted those. Those galleries contained stolen images. The copyright violation on those galleries is what got 'em down.

It is one thing to shut down a site because of a direct copyright infringement from the tgp owner himself but it is another thing to shut down a site because someone submitted a gallery and is using stolen images. If the latter is the reason APIC is shutting down TGP's, then they are wrong. I hope it is the first reason these tgps have been shut down because if it isn't then APIC better start budgeting for body guards.

This is what I do... If a friend has licensed a photo set -- and he is featuring that particular model at his site... It's stupid as hell for me not to be able to link to his site w/ a thumb pic of that model (I assume this is what you are talking about) -- but because I'm paranoid I just hotlink the other site's thumbnail... (with permission from that webmaster of course) -- That way the license isn't violated -- because I'm not hosting any unlicensed content on my site. In any case I don't think there are too many content providers that will bitch about a thumbnail.

Suze Randall would never have been as popular on the internet if so many sites hadn't stolen her content -- finally she got smart and created an entire biz out of it -- she trades traffic for the use of content... I would like to see more real world solutions like this -- instead of pathetic and futile attempts to shut down the internet which is a battle lost by everyone, even before the lawyers collect their fees.

Sometimes, adult webmasters scare the shit out of me, and convince me I should have done as my mother suggested, and become a lawyer. So much money to be made off the ducks.

First off, APIC can not shut down anyone. They have no authority to do anything. Now, they can issue some bullshit threat, and the webmaster that receives it can freak out and do everything APIC tells them to, but that is about where it ends.

Secondly, any site that has been told by APIC to close up shop, from my understanding, has been told to do so not because they posted a gallery with unlicensed content submitted by someone else, but rather because the owner of the TGP made his own galleries to post using unlicensed content.

Since English is not the native tongue to everyone here, let me give an example.

Say you own dumbasstgp.com and you get 100 submits from different cheaters with stolen content, and you post those galleries, APIC, and no one else can say shit.

Now, if you own dumbasstgp.com and you are not getting enough submits, so you steal a bunch of content (not licensed to you is stolen) and you make your own galleries to give your TGP some content, and this content is licensed by APIC then yes, they can threaten you, and tell you to take your site down.

However, it is up to you if you take your site down or not. If you do not, it is up to them if they want to take you to court or not.

In a nutshell, if you use unlicensed content, you are asking for trouble, and deserve whatever trouble you find yourself in. However, if you run a TGP and happen to post a gallery that someone else has unlicensed content on, you have no worries.

Hope this helps clear up some confusion. Those still confused should close up shop anyway.

i pretty much agree with everything you just said.
if a site shots down becuz of APIC, he is either a coward, or he has really done a bad business and would get into really big trouble if they go to court.

To answer your question though, Suze and Vivid make their money through licensed content.

Affiliate programs that may give their content away for free have license to do so, and they are making their money from advertising and signups to their programs

No one makes money by having their stuff stolen, unless it is insured and they are pulling an insurance fraud scam

Racquel Darrian is a perfect example. In the old days Racquel Darrian was one of the most popular links on my site -- I sent out 10,000+ visitors/day to Racquel Darrian links -- I had links to galleries with every pic that every horny guy in the world had found, scanned, stolen, etc... There was no affiliate program -- there weren't any pornstar affiliate programs either. There was no incentive for anyone to purchase pornstar content. Just like there is no incentive to purchase Playboy content -- because you can't buy it! It was virtually impossible to buy pornstar content back then. Ask Steve from Pornqueens... I remember when he was one of the first guys to be able to find a pornstars CD... It wasn't until the Racquel Darrian affiliate program came out that webmasters started pulling down their pics in favor of pics provided by the Racquel Darrian affiliate program.

So I think you are missing my point -- I'm looking at the big picture. If there were no affilate programs there would be a lot more sites with stolen content -- that's a fact.

W/o affiliate programs, the fans of the models and pornstars would be building sites with free stolen pics -- regardless of profits. Not APIC, not anyone can stop people from wanting to share pics of their favorite models, pornstars, etc... Just jump onto IRC and you will see hundreds of people trading pics. You can't stop it. Just like the music industry will never be able to prevent people from making mix CD's for their friends of their favotire "stolen" songs.

first off, if you are not making a profit, or selling pics there is no copyright infringement, so for fans to trade pics among each other is not a problem

I know someone will bring up Napster, so, Napster made money with the advertising done on their site which provided a vehicle for trading music.

As far as whether or not Hustler has a problem dealing with webmasters, I think for the millions we bring, they will sink to our level without too much problem

A cautionary note: APIC can shut a site down the way anyone else can - by complaining to the upstream provider. You just do a traceroute on the offending site and you can find out right away who the providers are. For example, my sites are hosted by Strictly Hosting, which has been in the adult biz for many years. But upstream a bit from them is ATT Canada. Those guys aren't in the porn biz, they're in the Internet biz. They don't care about any of their clients as much as they care about keeping their connection to the Internet. If APIC complained to strictlyhosting about something I had on one of my sites, and strictlyhosting wasn't responsive, they could keep complaining upstream until they found someone who responded. And then it would roll downhill until it got to me.

This is an interesting change for the porn biz. I've been in porn one way or the other since the late '70's, and back then it was quite common for video companies to steal competitors' loops and put them together to make their own videos. Courts wouldn't enforce the copyright because they didn't (and still don't) have any interest in protecting porn producers. Even today, if I found some footage from a video I made on somebody else's tape I probably wouldn't have any recourse. But if I found my pix on somebody else's site I actually have a way to do something about it now.

"your pics are fine... but all that jibberish at the bottom, clutters up the gallery... try removing it and resubmitting"

The jibberish was the 'pics are licensed and conform to usc 2257... copyright etc etc' notice

I wonder if the reviewer might rethink that particular rejection... in light of...

Pretty fascinating stuff... I was told that these unlicensed pic hunters even have the power to shut off DNS service -- so that sites w/ unlicensed pics hosted in foreign countries aren't even safe... Is this true?

Yeah, the good old days LOL Half the pornstar sites on the web at that time were just saving my pics, and they usually didn't bother to change the file names! And some of those high priced CDs were as legal as scanned magazine pages. It is a lot easier these days. Plenty of places to buy pics.

That Raquel Darrian program - those guys would surf our link sites and then either shut down the fan sites, or make them run her banners. They did a good job of killing her heat. She used to be the hottest woman on the Web, now she's nothing compared to Jenna Jameson, or Sylvia Saint. Lots of images of those two out there, and it fuels the demand.

By the way, I found out about Suze Randal's pics4clicks program from Steve Easton of APIC. And he also told me about Ounique. I always thought he was cool to deal with, as long as you didn't freak out over his first e-mail.

None of that is true - in fact - if someone attempts to remove your site - without following the law - THEY ARE LIABLE FOR DAMAGES:

That is a summary of the law - read around 12 - 14.

Basically, to shut down your site - they must certify in WRITING under the penalties of perjury - that your site is infringing to your upstream provider. If they lie - or make a mistake - they are liable for your lost income.

You must be notified - and then you have certain rights - if you own a TGP - you are supposed to do the same thing - the copyright owner certifies in writing that one of your links leads to a copywrited site. You take it down and tell the person that submitted it so they have a chance to respond and defend themselves. The TGP is protected - as long as it receives the required notification. You are 100% protected if you do business this way. You DO NOT NEED ANY PROOF UP FRONT to protect yourself.

I would be happy to write up a summary of the law and exactly what must be done by link owners and the like, but nobody seems to read my posts anyway If people want it - I will do it.

The laws on this are 100% clear.
