ANTI-SPYWARE CONSORTIUM COLLAPSING
An industry group created to set anti-spyware standards and help consumers identify spyware on their computers lost three key member companies after an adware company was granted membership. Webroot Software, Aluria Software and Computer Associates International's PestPatrol announced their departures from the Consortium of Anti-Spyware Technology vendors (Coast) after 180Solution was granted membership.

UTAH TRIES AGAIN TO BAN SPYWARE
Utah has re-worked the wording of its ban on spyware, to get around a finding last year that the law is unconstitutional. A proposed new law requires advertising companies to pause before transmitting spyware and inquire whether the recipient is a Utah resident.

FOLLOW UP STORY RE: RFID CRACKED
In the last edition of Internet Law Highlights for GFY http://www.gofuckyourself.com/showthread.php?t=424673
there was some discussion about RFID technology being used at the US border. Shortly after that edition was posted, a story ran in the mainstream press about how RFID has been cracked. Thanks to the folks who pointed out that the Dexit and PayPass schemes, currently being promoted as cash replacements in Canada and the US, are also based on RFID technology.

If the Blog includes "a discussion forum, in which any user could post messages..." then an argument could be made that it falls within the judgment. Also, according to the decision, "it is not relevant to immunity status that the website is not commercially operated or is directed at a relatively limited user base".

Maybe in the comments section but as for the blog owner/manager's own posts, probably not. The key here is who is in control of the content... you can control your own actions but not others responding/starting threads.

I agree. If we're just talking about the part of the blog where the author writes his/her own stuff, then if blog author writes something defamatory, he/she is on the hook for it. However, if the blog includes a forum section where readers can contribute, then that section would arguably be treated like the discussion forum referred to in the case.
