I don't think it should be a felony... until/unless the video is shared or published. If it's used for "private" gratification and no one knows about it but the photographer ... where's the damage?
Similarly, if the subject is unidentifiable, no damage is done... Still, it should be at lest a misdemeanor. We can't have women feeling like they're being watched from below every time they go up stairs or use the bathroom.

I was in a bar 2 weekends ago drinking with friends and we had a digital camera there and took some pics since it was 1 person's going away party from the wife's job.
There were a ton of babes there and 2 of them asked to get their pic taken. I was buzzed and since we all got carded on the way in, they were 21... in fact 26 & 30.
I take their pic and thats it, go back to drinking.....
hour later I go to leave and the babes husband comes out and totally freaking out that Im going to be posting his wife's face pic all over the net, perverts like me need to be arrested, etc... he TOTALLY went mental.... especially when I told him that Im not using her as content, I have no release and she ASKED to get her pic taken in the club. I offered to delete it, he was just refusing to stop screaming pervert and shit, lol
It almost got into a street fight until a few of my homies that were there asked him if we wanted to step out back to talk more. He declined but, it made me think of the ramifications of when you take "voyuer" pics of what can happen if a nutbag approaches after the fact.Comment

I remember on one of the 20/20 type shows they had the case of one guy who set up cameras in a changing room used for friends who came over with their children to swim in his pool.
He could not be brought up on any charges because none existed covering hidden cameras in his own changing room.
Another guy actually set up a camera in a neighbor's house and watched her shower...a landlord did something similar. NO EXISTING LAWS were broken because they were given entry so they couldn't even get them on unlawful entry.

I'm not sure if you were in Vegas when they had the guy who was videotaping children and teens at Wet n Wild, zooming in on their asses, crotches, etc. and nothing could be done about it because they were out in public and he was taping from a public sidewalk...he was then selling the videos on the Internet...I think they finally nailed him for improper business license or some shit like that because even though what he did was clearly wrong, there were no existing laws against what he was doing...Comment
