I have heard that there was a copyright case in a US which found that it is not a breach of copyright to show thumbnails of images without holding the license. could someone please point me towards some more info?

What about using thumbnails of images from sponsor hosted galleries on your own TGP? You don't own the copyright for that thumbnail but you are linking to the sponsor gallery...

like asking if it is okay to use amateur pages banners to link to amateur pages.
Correct me if im wrong but wouldn't thumbnails be considered banners? Which most content license allow use of their content as banners, which allows the banners to be hosted on any domain as long as it links back to the site that holds the license.
So why would anyone think thumbnails are illegal..

Notice the fools who fight for fair use dont own any copyrights to anything.
If you did, you wouldnt hide behind such minute details.
I take plenty of pics, and everyone of them I post has my URL on it, for a reason, I dont trust one fuck when it comes to my own images.
Just think if all the pics of my herbs I post, some fools were collecting them and making a site about them and popping "Piss test" pills on the pages, thats cool right?

I see people arguing all the time they don't want their pictures thumbnailed (mostly non adult) and even people that DO NOT WANT search engines visiting their pages.
You should see all the bitching on some of the google boards about google caching their pages and the image search. I have made thousands of dollars off of googlke image search and cache traffic.
Sometimes people shoot themselves in the foot. Thumbnails in these types of cases almost always indirectly help the photographer and their clients.
Copyright is a legal protection to encourage artists - it is not an absolute license for all eternity.
if there is precedent i would like to know, and so would any thumbnail preview tgp webmaster as we host thumbnails submitted to us by apparent licensed users, but technically the thumbnails preside on our server..
