50 cases dismissed....

I still think the web adult industry has some issues separate from this due the lack of age proection or verification before our content is shown. Also with regards to porn coming up for non adult related terms etc. We need to find a better way to protect minors from easily accessing the material, which we currently don't do that well of.

But still a good victory which provides good legs to run on in the future.

I just finished reading the whole memorandum on the case and the interesting thing is this:
It wasn't about whether the EA product was obscene or not.
If the Supreme Court had not ruled that Texas had no right to prevent homosexual acts of sodomy sex between consenting adults in the privacy of their own homes (in 2003), the EA case would not have been dismissed.
3 Supreme Court justices dissented in that decision: Rehnquist, Thomas and Scalia.
The scary thing is this:
WHEN Bush appoints more conservative judges to the bench, the governement will WANT to appeal to the Supreme Court, and dismissals like this will be overturned.
If you don't think this narrow-minded right-wing administration can do LONG TERM damage to the adult industry, you're wrong. We already lost the war when they were re-elected. For me the last elections was all about who will sit on the soon to be vacated bench seats...
Supreme Court confirmation hearings will be the thing that either keeps us free or puts us in prisons. (That and federal court appointments.)

That's right bigJB - old uncle Ronnie was a huge pain in our asses back then.
It starts at the top and rolled right down to local legislation.
When our Ohio Senator Voinovich first ran for the Senate, he was mayor of Cleveland and had his vice cops bust me 3 times - I was charged and tried once, and convicted! It was overturned on appeal... I had an unfair trail and my attorney had a huge opponent in the courtroom in the form of the judge!
The second time was under George Sr.'s administration and it was in the city of Indy. 9 of us narrowly escaped convictions in that case, it included 2 counts of RICO for christsake and would have put us in prison for about 28 years each.
The feds set the tone, and the states and local legislature, right down to the town council all follow suit and want to run every adult video store, strip club or massage parlor right out of town on a flaming hot rail to hell.
I'm no friend of the right wing... but I'm no stranger to them either!
If people really knew their history in this industry, or if they knew what it costs to defend yourself in one of these cases, they would run away from it as fast as they could and build happy little websites... for children... or seniors or something.

Everyone dogs Clinton, but I'll tell you this - the number of federal prosecutions for obscenity under that admin was: ZERO.

Everything you described I've been trying to tell people like Warchild about for months...even years now.

I was not involved in the adult industry during the Meese Commission, however I took particular interest in how things played out.
In Fort Worth, Texas you could not find an adult video anywhere. My local shop that I rented from one day had adult videos and I swear the next day almost threw me out when I asked why they no longer had them...denying they ever existed.

As I have tried to point out to so many here that the game does not just revolve around obscenity. But they like to use things like zoning laws and even go so far as to rezone places so you have to shut down or spend years and tons of cash to fight it.

It's a game in the long run they have the upperhand on against most adult "entrepreneurs."

2 judges will need to be nominated soon .. think they will be liberal... The Supreme court is the LAST line of defense, and will taken over soon...

I have been prosecuted here on 120 counts of distributing obscene material... ( in 1995 if my memory is right). They started with the first count . I was convicted . On appeal, I won on a technicalilty ( not on the content). They proceeded with the second case: same thing. I finally got them to drop the other cases when I myself brought the first case I had won to Supreme court on an old British law... The crown ( da ) didn't want to go there, scared to loose ( I had told them I had trucks fuill of porn VHS ready to flood the country the minute I won in Supreme).

All that to say it cost near 100K at the time.... Maybe they don't win, but they put you in the poor house.

Meanwhile , Veterans day and Warchild and others, continue voting for right wing religious dishonest selfish liars.... and believe your are safe.
