Dear Signup4cash Affiliate,
Please view the court order in our case at http://www.signup4cash.com/order.pdf We first want to thank you for your support as an affiliate and express our gratitude for being able to work with you. As you may have heard we are involved in litigation with the United States Federal Trade Commission for alleged violations of the 2004 CAN SPAM act. The complaint alleges that we initiated spam by paying affiliates to send it. We have linked to a copy of the court?s preliminary injunction in this matter for all of our affiliates to have a chance to read over it. There are certain implications for our affiliates. Per the order, each of you is ordered by the court to be CAN SPAM compliant in your email marketing campaigns. We know that in the past a lot of you have endeavored to be compliant with the law but there are a lot of particulars that have to be handled properly. Please review articles 1 through 5 of the order to find out exactly how to make sure your mail complies with the law. Following the freeze of our assets, our affiliate databases and all the sales and payment information on them were replicated by the FTC. We had no control of this. There is a good chance some of affiliates will be contacted and an inquiry might possibly be made by the FTC to determine whether the sales you generated in 2004 were CAN SPAM compliant. Should you continue to send your email traffic to any other sponsors we highly encourage you to comply with every single aspect of the CAN SPAM law. Because there are so many intricacies and details to it, you want to be sure that you don?t miss one and get in trouble when your intentions were good. We suggest you talk to an internet lawyer to certify that your email method is 100% in compliance. Because of the nature of our situation at the moment we have made a decision to not accept any mail traffic at all, regardless of whether or not it is CAN SPAM compliant, as we wish to avoid any possible implications. All other forms of traffic are welcomed to continue and payment will be as usual. The Federal Trade Commission has acknowledged that we have a legitimate affiliate program and it is not suspect. Their only issue was with any sales that may have been generated by non-CAN SPAM compliant mail. If you wish to clarify that your traffic is ok, please email me at [email protected].
