2257 and why AFFILIATES should care.

My As most of us already know, there were a handful of companies that were served at Internext by the Feds/DOJ (be it who it may) for allegations surrounding viotations of the CANSPAM act.

Here is something on my mind, that I though I would open up for discussion. Spammers are one thing, but lets talk 2257 compliance. No person of company to my knowledge (please correct me if I'm wrong) or any stature in this industry has been popped for non-compliance.

Imagine what happens when lets say an average pay-site based program does get nailed in non-compliance. Hypothetically speaking lets say this is the case:

Company Name: Porn Company, Inc.
Monthly Revenues: $1,000,000.00
Program: 20 Sites, 30 PPS, 50/50 Rev Share
Affiliates: 4,000
Monthly Payout: $850,000.00

(This is all made up, so all the haters and idiots.....well, you know....read the top of this page)

Any company (keyword COMPANY) running a program with even one section not in compliance could be shut down virtually overnight. This means no payouts, pissed off affiliates, and court battles that could last years. People (and by this I mean webmasters alike) are pissed now about things like iBill? Just wait until the Feds and Department of Justice get the need to scratch that itch that is 2257 compliance.

Think of the utter destruction it could do to this indusrty overnight. Feds don't "ask" companies to take down the one site that was not in compliance, they shut down everything. Everything. That means bank accounts too. And if the sites aren't up, members are sure as hell gonna bail like rats off a sinking ship.

Ok with Ashcroft leaving this 2257 will probally be put on the back burner. Secondly no one has EVER been "popped" for the existing 2257 rules since they have been law, which is over a dozens years now.

The answer is simple, don't do business with companies that aren't in compliance, don't put all your eggs in one basket, and contribute to the Free Speech Coalition's 2257 defense fund so they can get the new regs struck down in court the same week they're published.

I'm a bit confused...With all these new 2257 laws that I keep hearing about...I understand that I may be required to get copies of models ID's and such in the future.

That seems like a llot of work to me and what if the model doesn't have or want to give me ther ID?

I just hope these new laws don't pass.

They don't have to pass to become law. Just for the AG to say they are law. Congress gave him that authority. All he had to do have a "public review" period beforehand and that ended in Spetember.

If 2257 is so powerful, they why don't they add that charge while they're fucking people over? For example, read the charges filed against Extreme Associates. They listed this and that, but no where did they list "2257 violations."

OK, so maybe EA was in compliance. But surely someone somewhere who got popped for something was not. Why no 2257 charges?

Well, whatever the reason, it's so easy to comply that only an idiot would ignore it. Just comply and don't worry.
