gena lee nolin's lawyer called me once about a verbal cease and desist...my wife freaked out...haha...

but fact is, until you receive something at your doorstep that is marked either official or ceritifed, then don't do shit

However, I too am not a lawyer and this is most definately legal advice.

check your laws dude.....seriously...hire a laywer...figure out what laws mean what and what your rights are...you would be suprised

c&d's are almost never legally sent out via email..if they are they are bogus...shit, I DO THEM ALL THE TIME for companies stealing my paysites content

eBay sends a C&D out via an automated system after a domain with the mark "ebay" in it is registered. I am sure those are bogus.

IMHO You're better off emailing them, or contacting them on ICQ.

i did sit on the phone with gena lee nolin's laywer for almost 15 minutes and tell him my address and business name...then talk to him about what he need for me to comply...for almost 15 minutes...

and from the advice from my lawyer, I never did

and I never heard from him again....in fact, after that phone convo there were about 100 more GLN pages that popped up less than 2 weeks later

BUT HIRE A LAWYER, STOP ASKING FOR LEGAL ADVICE ON GFY

I'm actually so woried about this email that I am going to read more than the first paragraph by tomorrow night, I am almost positive. I think. Actually I may just forward it to a few people and see what they say about it.

GFY is a sounding board for me, not a church. If I really thought this letter was serious, I would never ask anyone for advice besides my lawyer - however, my lawyer charges $50 just for me to call and ask if she's available, so I tend to make my own calls on most stuff.

I do appreciate the "get a lawyer" replies though, it realy shows that some people on here care and would rather help someone out than look like they know what they are talking about.

The main place i promote LL is through the cobrand, so I'm more interested in if LL has something to say about this (such as "Don't worry Wolfy, I got it handled!"). We shall see :D

Possible it will get delivered by postal too. It takes more time than an email to arrive. Ignoring C&D sent by email is stupid since anyone can sue you without any warning and be assured you'll find it out by certified mail in that case.

Agreed. It's always kewl to get a feel of what people have to say here on GFY. But legal stuff should be handled by your representative. Yes, I know there are costs for consultation, but if it is important to you. You'll not only seek the advice from your lawyer, but find ways to ensure that something like this does not happen again; or even better yet, work a deal so that it won't cost ya a lot every time you see ur lawyer. best of luck

I got C&D's in 97 when I was a newbie from playboy and victoria's secret cos I was clueless enough to get domain names with those keywords. And I did C&D'ed ie. transferred the domain names over to them. If it's only some stupid gallery, just remove them cos that'll be way more cheaper than to even see a lawyer unless you're quite definite you are not infringing on any copyr.

If you received a C & D, you should talk to a lawyer, regardless of how it was delivered to you.

You should rarely take advice from the mental midgets who frequent GFY.

And, FYI, the copyright holder has NO LEGAL OBLIGATION to even send you a C & D. Upon discovering infringement, they could simply sue you. Your first notice would not be a C & D, but rather a summons notifying you that you have been sued.

C & D's are usually sent as a courtesy to 1. Stop the infringement and 2. Faciliatate a quick and inexpensive resolution.

You should get a lawyer and let him/her advise you as to how to proceed.
