Someone stole my domain !! Am I fucked ?
A few weeks ago I got a notice that my domain would soon expire if I didn't renew the subscription within about a week. I misread the date and didn't get around to renewing in time. The domain became unavailable for a few days and when I could do a "whois" for it again (I tried daily), I could see that someone in Canada had bought the domain and it's now a page with banners, pop-ups and blind links
![]() But it just so happens that the domain was "henrikh.com" (which is my real name). I read someplace that I can legally claim the domain as my own (unless his name is also the same as the domain name). Do I have a chance of getting my domain back and how do I do it ? Any help will be greatly appreciated. I have lost valueable traffic and money since this incident happened and I want my domain back. |

... your domain did not get stolen, it just became available because you have forgotten to renew it and unless you have a trademark or something there is not much to do about that
... on the other hand you could just make the guy that bought it a nice offer, or explain it to him ... ------------------ Don't innovate - imitate! ... giving away mass traffic for free !! |

the guy didnt steal your domain, he just registered. The best thing you can do. Send him a fax/email with the info that will prove your surname is the with the domain you owned so far and asked him to give it back to you. Otherwise,you're going to take legal actions against him. It will be even better if you had a lawyer to do so. There's a high possibility to give it back to you. Many celebrities have gain similar cases.

Ever hear that saying "Finders keepers, losers weepers"? That pretty much applies to domain names. Theres no reason why you shouldn't renew your domain MONTHS before it expires. The only thing you can do is to email the new owner, explain what happened and wait for an email back from him/her containing at least one of the following:

Thanks for your replies. I know that it's my own fault that I didn't renew the domain in time, but I still think I have legal right to the domain (because of my name) unless he can prove that his name also entitles him to have it. I sent him a mail explaining this. We'll see what happens next. I will talk to a lawyer and see if I have a case or not.

Legally I believe you have a 90 day grace period to renew your domain even if it expired. Call your registrar and talk to them.

i thought u have to wait 30-40 days after a domain expires before you can pick it up.
there's one that's expired right now that i want, and i can't get in until dec. |

Mine was unavailable for only about 5 days. Another thing that puzzles me is how did he know that this domain had so much traffic ? The name has nothing to do with porn or anything ? Are there any tools for spying on domains/traffic and grabbing them the minute they become available ?

The fact that it's your name doesn't mean shit. You do not have the right to that domain simply because you leased it before.
If you had a trademarked product, or company, named that then you might have a case. Otherwise, he's probably gonna want your first born to sell it back to you. |

Ur assed out once the domain expires there is a grace period already included before it becomes available again. Once that is passed up its his!
Dont get your hopes up, if there is traffic to the name and he's smart enough he wont give it back. |

A friend of mine owns a .com of a famous name that also has trade marks and the only way they can get this name is by buying it from the owner. If you are using that name with conflict of interest, trade mark or copyright then there is a legal case but not for surrendering the name.
Like errr who claims johnsmith.com ? Bite your tongue learn the lesson and call it another day. Wish I had $10 for every time my lapsed housekeeping has caused a mayor fuck up. If you have any cross linked pages or traffic trades to this lost name get the links changed to a new name asap. With luck this will reduce the SE?s ranking value and also drop out the trade traffic. |
