This is the story of exactly what happend

sam = the kid who was hit by the car
bo = kid who owned the car
cupo = kid driving the car
krystal = sam's sister

****aries4 (3:42:44 PM): sam was leaning on krystals car telling her where he was going, and telling her to come with him.. so krystal was like no just go out so sam said yea bo and cupo are picking me up, and then hes like oh - there they are right now .. so when sam back away from the car to go to the other side of the street to get in bos car, anthony was like fooling around and going like 80 krystal said he was going really fast.. and hit sam

i'm fuckin torn up over this my cousin passed away during last christmas he got hit by a drunk driver in florida then this happens such a rough time of year for me i'm drunk and dunno what to do with myself

How unfortunate...my deepest condolences

an older friend of mine commited suicide last 2 sundays ago, i guess he was unhappy since he was divorced and wasnt doing so well.

i remember when he helped us move one time not so long ago and he stayed with us....

A 16-year-old Nutley High School sophomore was fatally injured early yesterday morning when he was struck by a car in the township, authorities said.

Samuel Hernandez was crossing Franklin Avenue about 1 a.m. when Anthony Cupo, 19, also of Nutley, was driving north and struck him with his 2001 Lexus, said Detective Sgt. Steven Rogers.

Rogers said Samuel was talking to a neighbor, across the street from his apartment, before crossing the street again to return home when he was hit.

Rogers said when police arrived at the scene the victim was still alive and attempts were made to save him. He died about 1:30 a.m. in Clara Maass Medical Center in Belleville, Rogers said. There were three other passengers in Cupo's vehicle and no other reported injuries.

The accident occurred near Sergeant Street, where the speed limit is 25 mph. "We believe (Cupo) was exceeding that speed limit," said Rogers. "We haven't gotten the exact speed because the investigation is continuing."

Rogers said a preliminary blood test revealed Cupo was under the influence of alcohol. He faces first-degree charges of vehicular homicide and driving while intoxicated. Rogers said there will be further toxicology tests to confirm the presence of alcohol.

If convicted, Cupo could face up to 20 years in state prison. Rogers said Cupo also was driving with a suspended license, but he did not know what led to that action.

Samuel's death sent shock waves through the community.

"We've received literally hundreds of calls this morning from students of Nutley High School," said Rogers.

At the Franklin Avenue apartment where Samuel lived, his mother said, "He was loved by everybody. Many, many people loved him."

"He was a good person and he was a jokester," she continued. "And it'll never be the same."

"Sam was an outstanding young man with a bright future ahead of him, extremely well-liked," said Nutley High School Principal Joseph Zarra.

"And to make it even more devastating is to have this news reach us on Christmas Eve. It's something that's difficult to comprehend and deal with our students. We're going to make every effort to help them deal with this."

Zarra said school district officials are planning to put grief counseling in place this week during the holiday break when school is closed. Zarra said he's already met with a group of Samuel's classmates and family.

"I think the measure of Sammy's impact is the amount of students and the significant amount of grief they are feeling at the loss of their friend," said Zarra.

A woman who answered the phone at Cupo's residence declined comment.

Cupo is being held at Nutley police headquarters, where authorities will process him and set bail. Rogers said the investigation will continue through the Essex County Prosecutor's Office.

with a 2001 Lexus, dont worry about the burrial cost. The family will be taken care of, though it may take time to get the money. It's coming up on a year since my Lexus VS my motercycle accident and I havent seen a cent, but I will eventualy.

the kid driving didn't own the car it was his friends car and he didn't have a license and the lexus is totaled...


they're not getting any money of out the kid who hit him his mother is a stripper and he's a drugee they don't have much money

the owner of the car was sam's best friend and he isn't chipping in considering he didn't hit sammy. his father bought him the car the kid who owns the lexus is a 17 year old thats still in high school.

my father did a fund raiser for a child in the local little league when he needed funds for a brain tumor operation they raised over $20k i think he's gonna try and put something together again last time they held big dinner at this place Crystals it went well. I feel bad for sam's family they must be torn apart...

You go after the owner of the car unless it was reported as stolen prior to the accident.

You go after the parents as well since he is a minor.

This will take years to sort out but the family will get paid.

The sad part is the loss of a child. Nothing will make up for that.
