Cavecreek hosting, I wonder if this is legal ???

Friend of mine received a payment reminder from cavecreek hosting containing the following line, wonder if this is legal ??

"If you are a CCBill customer, your CCBill account will also be placed on hold until your Cavecreek Web Hosting account is paid in full. CCBill funds will not be released until full payment is received for your Cavecreek Web Hosting account. CCBill funds cannot be used to pay the balance on your Cavecreek Web Hosting account."

Sounds fair and they are the same company so you dont pay then you dont play. They can sure has hell withold payment from the CCBill side and if either side took it to court the money would get tied up even longer.

So what could be illegal about them asking to be paid what they are owed?

I think they should keep all your money forever so you will crawl in a corner and die of depression of that $5 you lost!!

I usually change contracts on the spot before I sign them. Surprisingly the people who hand me the contract are the ones who rarely check them when they should.

We were going to use cavecreek for some of our hosting, but seeing as we use ccbill as biller, decided best not to place all eggs in same basket. Nothing against CCBILL or Cavecreek
CCBILL r great and the package offerd by Cavecreek was good.
But still in todays climate thought it best to keep it seperate.

We still in the market though for top managed dedicated hosting ?

your hosting bill with cavecreek is something like $2k with this policy you would be required to pay that $2k while maybe never getting this $10k from them ! and thats just wrong !!!!!!!!!!

not sure that is legal at all, it would depend on the contract you signed with them and I probably how CCBILL and Cavecreek are set up corporately. If they're seperate corporate entities I don't think they can legally withhold money owed to you from one company they own because of a debt you have to another company they own.

interesting though, i'm curious to hear from a lawyer what the law it on that situation.

odd that none of the adult industry lawyers have a board whore to answer questions and drum up business for them.

why would anyone fucking host with them anyway?

i just did their custom server page...i set in my exact specs for my dedicated...and it came up to $4200 a month with a $5165 setup fee

i pay $299 a month and had free setup

Personally I dont think it's legal. If they are set up as two seperate corporate entities it is most definatley illegal, unless there is a clause saying they can hold funds for any reason.
But serioulsy, legal or not that is shady. Bottom line. I'd expect better from any ccbill ran company.

The first part makes sense... CCBill won't pay you all your $ if you still owe for hosting...

But the second part... That's the "rub".

i.e. if CCBill owes you $10K, and you owe CCWH $6K, you have to send CCWH $6K before CCBill will send you the $10K.
Rather than CC just sending you the $4K net in the first place.

Haha our lawyer usually changes them before we sign and send them back too

Been mighty handy in the past too i might add.. just because something looks similar to the one you sent me, you should still read it in its entirity to make sure
