If the menu and template originally came from one of those sources, then it's really your own fault (or your designers) for not creating a design that you hold the copyright on.

No offence, and I could be wrong, but this design really looks like a cheap template that anyone can buy. Maybe this guy just bought the same template and that's it.

It's not always the company's fault. A few years back I had a designer work on a project... dude, the MOFO came back with a kick-ass design. A few weeks later we realized he copied it from another website...

As already pointed out by Brain Cash, the design was done in house. This isn't just using some html written by someone else. It's theft of unique graphical content. Are you really this stupid?
