In need of a good internet lawyer to sue the ass off some punk

That's right kids! After practically begging to get a multiple bounced check issue resolved in a civil manner, I am left with no choice than to deal with attorney's (which I hate to do). Mine suggested I contact someone in the adult field, and I was thinking about finding one for my business anyway, anyone have any recomendations?

Check out attorneys in the state of your defendant. They will be familiar with what is needed to effect process in such cases in those jurisdictions. This is an area where many attorneys screw up. Having the check should make things pretty easy for them and they should be able to get summary judgment (pretty sure they should).

If it is a contract dispute - I see no reason having an adult attorney will be any help. Seems like a simple case, except for the jurisidctional issues (if you two are from different states).

bounced checks are a criminal matter. Have him arrested. They usually pay up quick after that.

Good luck in trying to get the police to investigate that IN A DIFFERENT state - for a corporation. Good luck in trying to get them to investigate in your state for that matter. Just because something is technically a crime, doesn't mean they HAVE to or will investigate it.

All you gotta do is either you -- or hire someone -- to go over to the magistrate in the county where this took place, and have em swear out a warrant for the bad checks. The check writer will get arrested and then it goes to court from there -- I don't think you'd even have to be in court, the court would collect on the checks and you can get the money.

KimmyKim, I gotta tell you, when it comes to info in this biz, there's no one close to you, it's not as much fun, but the thought of this guy getting arrested makes me VERY VERY HAPPY

In Arizona, where I live now, as well as in NC or any other state I can think of that I've lived in, writing a bad check is either a misdemeanor or a felony, based on the amount of the check that was written.

In the case of a business check, the owner can be held personally liable if they signed the check.

When you go to the magistrate to file the paperwork they will tell you exactly what to expect from the number and amounts of the checks --

The best suggestion here to find out what's up would be to call the magistrate in the locality where the check is drawn from since that is where it will have to be addressed, and ask them what the specifics are to their jurisdiction.

(Can you tell that I've had to go after a couple people over the years? Running retail/wholesale businesses where checks are a common currency always involves someone writing a bad one, sadly enough...)

How much are we talking here?

If you had a contract, and he wrote you a check - you should be able to get a lawyer to give it a shot. Unless I am missing something - it seems pretty clear cut. You had a contract - and he wrote the check after it - so you must have lived up your part. There are even companies that I believe will buy checks off of you for a % (have seen ads - don't know that much about them).

If he has the money, a letter from a lawyer in his state would probably do the trick. If he doesn't, then you are probably out of luck no matter what. I would suggest finding a lawyer that practices in WA - that has a web page and seems half way bright. Search for contract and collections.

You really want this type of lawyer, because they probably will write the original letter for you fairly cheap as they already have the templates in their computers. I have never used this type of service, but I know that lots of them do it for companies - you just need to find one willing to do one.

Usually they will point you in the right direction on the phone for free. Good luck.

I am hoping he is reading these posts, and gets the picture that I'm not fucking around, and as far as I can tell, if I can prove he did it with intent, which my emails that he sent me show, it is a class c felony, which is a bad thing.

Like I said I just want this resolved one way or the other, either I get my money, or I get my artwork back from his sites.

I posted the link for the specifics. I am not familair with the states you live in, but know that every case I am familiar with you need:

1) Proof of intent. This is IMPOSSIBLE if the check was written after delivery - as the person can argue why would they need to write the check when they already have the goods or services.

2) DL# - You need a driver's license number on a check. The Police will not investigate. Telecheck and all the others require this - this is one of the reasons. The state could prosecute, but they won't.

3) Has to be in the same state.

NSF checks require intent. You can not prove intent unless there is multiple checks over a period of time - at the time of purchase.

None of the three things mentioned have occured in this case. If you are able to get a judge/commisioner to swear out a warrant with no drivers license, and no proof of intent - then you need to quit your job and put telecheck and the others out of business.

They only exist, because the police will do nothing in most of these cases.

You are right, it is a crime. So is it a crime to claim back pain in an accident when there is none and rip off insurance companies. In either case - you can not prove it. You can prove it for closed accounts and that sort of thing, but in most cases the police put it with the rest of the files - in the file room.

In the case of a business owner - if there is more than one person signing the checks - you could NEVER prove intent unless there was a bunch over time AFTER the person knew there was a problem.

I'm not going to argue with you -- if you'd like to send me a bad check and not make good on it, we'll see what can be done lol

Simplest answer here was and is, call the magistrate where the check was written and they'll advise as to how to proceed.

I wasn't trying to argue with you - just give him the facts. You seem like a nice person, but YOU seem to like to argue with ME and your cases are clearly different than his. I provided a link to an official police site in that state to show what I was saying is true. So where are yours?

I will be happy to write you a NSF check - say $5000. If you can have me arrested for it - I will have CC Bill tattooed on my ass. You would have to pay the NSF fees.

Would you be willing to bet the same thing? Not sure what I would want on there.

I just don't like getting peoples hopes up for nothing. I am sorry, but you do not know what you are saying. He will never get the police involved - without something more. You can not hire someone to appear before a judge and swear out a warrant.

I am not being mean, just standing by my beliefs that the person that provides official links to something should win out in a debate of opinons.
