    Would You Be Pissed If A Design Company...

    Told one of your competitors about a site of yours they were designing before it was finished and the said competitor then started to get a similar site designed?

    We're talking a totally UNIQUE niche idea here that you would never think of in a thousand years.

    Well i dont know if you would be but i certainly fucking am!

                                      Never hired a designer, but I've already thought that if I did, I'd need some nice contract including non-disclosure of designs in progress. I'm surprised theres a loophole allowing it honestly.

                                          you have a right to be extremely pissed. if you have proof i'd think of suing. if a concept is that important to you you should have had the designer sign an NDA ........ even without the NDA i still think you have some legal ground to stand on if you can prove a designer handed your idea to a competitor.

                                                          What's going to stop anybody to try to copy the niche once it is released? It happens all the time.I think you are going to be wasting your money on a lawyer.Maybe they can't copy the design but it isn't against the law doing the same niche.

                                                                              People tell each others ideas ALL THE TIME.

                                                                              Its the weirdest thing with this business. Someone at my hosting company has showed me pages by other hosting customers and told me how successful those pages were. Even showed me how to look at their site stats to see how much traffic theyre getting, and who is sending the most.

                                                                              I've had conversations on icq where people just start spilling their guts about their most successful advertisement designs FOR NO REASON. I never asked them or anything. I guess theyre so proud they want everyone to know lol

                                                                                  It's one thing when a person volunteers information regarding their own business or practices, but its another when someone volunteers information regarding other peoples business. Information that this party would never have access to except for the fact that they provide them a service.

I am a designer myself and I mostly do my own stuff but when I do a project I have it in the contract if I can discuss it or not. I always keep my word on that also. Because it's his or hers intelectual property and I respect that...

                                                                                                          Simple solution. Hire an in house designer, with a non-disclosure and confidentiality agreement, and keep your law-dogs on retainer. Problem solved.
