I didn't ask if there was a law on the books to allow them to arrest him, I asked your opinion on writing on the streets with chalk. If there were no graphiti laws in NY you can guarantee they would still charge him with something.

They only arrested him because it was political. Its not a crime if its chalk, havent you ever seen kids writing on the sidewalks with it? Ive never seen any of those kids get arrested.

yes. it was. as an example for the interview. don't know if he asked permission or not. thing is, the cops didn't seem to know or care that there was chalk on the sidewalk. my guess is they saw it on the teevee and the word went down... GET HIM!

but seriously. kids draw on sidewalks with chalk all the time. i can't say i've ever heard of one being arrested/charged for vandalism.

I agree. There are also lots of people who try to get donations for placing art-work on the sidewalks. I don't think a judge could fairly discriminate against someone peacefully protesting with art (messages), and someone drawing images depicting something (messages).
