looks to me like the graffiti was already on the sidewalk . . . maybe I missed something with that crappy audio

yes. it was. as an example for the interview. don't know if he asked permission or not. thing is, the cops didn't seem to know or care that there was chalk on the sidewalk. my guess is they saw it on the teevee and the word went down... GET HIM!

but seriously. kids draw on sidewalks with chalk all the time. i can't say i've ever heard of one being arrested/charged for vandalism.

I agree. There are also lots of people who try to get donations for placing art-work on the sidewalks. I don't think a judge could fairly discriminate against someone peacefully protesting with art (messages), and someone drawing images depicting something (messages).
