I believe ,given some discussions about this, that the Canadian law considers SPAM like Free Speech. If the Canadians want to spam the shit out of themselves thats fine, but when their shit ends up in mailboxes outside of Canada, thats another story. Neither the Canadian or US Government ( w/ I CAN SPAM) is doing much to stop SPAM. The US is targeting a few mega abusers though.Originally posted by Myst

Unlike the US, there has been no high profile case involving AOL in Canada. I believe that there has been some American company that made an attempt to sue some Toronto based spamming group. I forgot the details but I don't think it went too far.
That being said, there are no specific laws against spamming in Canada. So even if AOL, MSN or Earthlink where to sue, for lack of a better term, they wouldn't have a leg to stand on.
