photo Id is a must.. Have her hold it up to her face and take a pic of it.. If you can have two forms oof id.. SS card, passport, licence.

I think a release should be written in PLAIN ENGLISH, not legal mumbo-jumbo. It is sometimes an effective defense for someone working for a small enough fee to argue, "Look, I was only earning $150, so it wasn't practical for me to hire an attorney to interpret it for me."

It is very important NOT to interpret the release to the model. This in itself could be used to invalidate the release. All I tell the model (and this is OK, since it's not self-serving) is that "The purpose of the release is to give the photographer total control over the images, so that he may use them as he pleases."

My release for stills fits on one page in 10 pt. type.

I always get two forms of ID. One has to be photo ID of the type which would be acceptable in a bar to prove that one is (or is not) of age to buy an alcoholic beverate. This includes state-issued driver's licenses or official age ID, Federal Govt issued photo ID, military photo ID, Passports (the page with the photo on it).

Birth certificates are useless for proving age, since there is no way of telling if the person presenting it is the person in the certificate.

The secondary ID would ideally (and rarely) be a second government-issued photo ID. I also accept birth certificates, various kinds of licenses (e.g., a nude dancer license of the type issued in Washington State), student ID's, library cards, credit cards (with the account # obliterated), vehicle registrations, utility bills bearing the model's name and address, etc., etc., etc.

My video release is just a bit longer, but in 8 pt. type, it could probably fit on one page.

I never agree to modified releases. It's important to me to know what is allowed and what isn't when I'm negotiating on the phone and in e-mail. Since my release says everything is allowed, this is no problem.

Once, a model refused to sign a release at the end of a session unless I agreed to her royalty formula. I countered with a clause limiting royalties to the first year. Once she signed it, I put her photos in a drawer for a year. Now I have the model sign the release before the session. And I pay her at the end.

Then, there is the matter of the Custodian of Records. The law is pretty clear that this has to be either the person taking the pictures or an employee, and that the records need to be kept at the business' primary location. I note that some content providers have made their attorneys the Custodian of Records, and the attorneys' offices the location of the records. I'm not sure how this is possible. I am my own Custodian of Records and I keep them at my place of business, which happens to also be my home. I list my street address but not my apartment number. I'm sure that if the FBI has a good reason to talk to me, they can ask my manager which apartment I'm in.
