Paris Hilton vs. Google?

I just got this in my email. I thought it was interesting and somewhat alarming:

Google has been notified, according to the terms of the Digital Millennium Copyright Act (DMCA), that some of your webpages allegedly infringe upon the copyrights of others. The URLs of the allegedly infringing webpages may be found at the end of this message. The notice that we received, with any personally identifying information removed, may be found at http://www.chillingeffects.org/dmca5...?NoticeID=1330

The DMCA is a United States copyright law that provides guidelines for online service provider liability in case of copyright infringement. We are in the process of removing from our Google Web Search results the webpages that allegedly infringe upon the copyrights of others. If we did not do so, we would be subject to a claim of copyright infringement, regardless of its merits. See http://www.educause.edu/issues/dmca.html for more information about the DMCA, and see http://www.google.com/dmca.html for the process that Google requires in order to make a DMCA complaint.

Google can reinstate these webpages into its web search results upon receipt of a counter notification pursuant to sections 512(g)(2) and 3) of the DMCA. For more information about the requirements of a counter notification, and a link to a sample counter notification, see http://google.com/dmca.html

If you have legal questions about this notification, you should retain your own legal counsel. If you have any other questions about this notification, please let us know.

The affected URLs are listed below:

In order to comply there cannot be any visual aspect of the video - so those sponsors that are selling the video should maybe start thinking about making DMCA safe ad creatives.

Just a thought

We're you pushing TCG's websites on or around June 29th? From the looks of the complaint, TCG (NetMgt) is the named defendent and this seems to be Google's response to that complaint, by removing the infringing sites linking to TCG.

Hi Everyone,

Rick Salomon's attornies had been requesting that google do something about infringing adwords links that google was allowing for some time. Infringing links screw the copyright holder and the copyright holder's assignees.

Google reacted by removing links that Rick's attornies had showed to be infringing. Even if pages were changed up to promote an authorized ad, anyone who previously had an infringing listing was removed from google. The lawyers cannot go back and forth to see who switches up and non-infringing promoters who have never infringed are at no risk of losing their listings.

Surely this is controversial, but Rick and XPays are pleased that google has taken a proactive measure to protect the public from getting heisted and to preserve the value of Rick's intellectual property.

I don't know about Jay, but I wasn't linking to tcg's sites and I received these e-mails. I don't think it has anything to do with TCG now, maybe it's just a continuance of a case vs TCG from the times TCG's celeb sites had paris hilton tape review (and when TCG had cut webmasters' payouts for promoting their celebs sites with paris hilton tape banners/links stating that they had full tape :/ )

i did not personally inspect the 11 domains that google has removed so far- but i recognize several of them. they had used unauthorized images from the video and claimed to offer the stream or download (unauthorized). several of the links also had creative saying "see the infamous video..." when they did not have the rights to the video. legitimate loyal seo's benefit greatly and scammers who either got tricked by an infringing sponsor program or knowingly infringed all by themselves only have themselves to blame.

For those sites that were named in the DMCA complaint, have you noticed any drops to your domains traffic since Google is blocking these specific pages?

ie: Have the rest of the pages on your domain lost traffic as a result of this DMCA complaint?

wiredguy- the reason you see the tcg case is because that is the active case that alleged infringers get added to.

google is not the only company out there who is respecting the copyrights of others and the salomons are committed to protecting their intellectual property- obviously. hosting companies, billing companies and drm providers for example are being very cooperative in shutting down domestic and FOREIGN infringers.

rick surfs google every day and feels violated when he clicks on a link that says "download the infamous paris hilton sex video for free" when the destination site has no such authority. any content producer who allows infringers to mislead customers is making a mistake.

webmasters have not hesitated to question us about the legality of our TrustFundGirls and HotelHeiress exclusives. if you get approached by a sponsor with a suspect ad for you to promote- ask them to prove that they have the rights to the content in question. do not assume that sponsors have dotted their i's and crossed their t's. a few well known programs have already crossed the line and their confused affiliates lost their listings.

I still think Rick is a douchebag
fucking loser who made money off of something created with him with a certrain amount of trust...if only he'd cared more about Paris' feelings in making his money off of HER (face it, no one wanted to see that douchebag), I might give a shit about him...
that being said, he's within his legal right, but it still sucks that he's allowed to breathe the same oxygen as the rest of us....

So is someone going to get in trouble if they promote something like this?

http://gofuckyourself.com/showthread...adid=338554&s=

I guess I'm just confused if other sponsors allowed to push this video or not.

sykkboy2- you would be right if your assumption was also right. you would have made sense months ago but even common people make a different assumption about paris' feelings. anyway, keep buying into the media hype from november while the Business continues. This cottage industry has legs and feelings are not at stake.

evildick- haven't checked the other thread, but if you sell the dvd for physical delivery, of course that is not infringing. making someone join your paysite to then find a link to buy the video is deceptive however.

so, you settled then? well good for you and your company...

Simple Solution = Stop push that Rick's video. Which I will do.

Paris Hilton traffic has been nothing but a curse to me anyway.

That means nothing. "rick surfs google every day and feels violated when he clicks on a link that says "download the infamous paris hilton sex video for free" when the destination site has no such authority."

Do you really want to hurt Rick's feelings?

By the way Jay... That's terrible news. . Her traffic is cursed anyways. I've taken down my ad's as well.

shermshack- it's not rick's feelings that get hurt - it's his copyright that gets hurt. if i get #1 for your exclusive content and promise the surfer access and then give the surfer my usual site without your exclusive content- you would be pissed off.

xxxjay- i would like to help you if possible. we had a few webmasters who had noninfringing ads at the time their links were taken down - but so far it seems all of them had infringed in the recent past. the timing is the issue as the attornies log an ad as infringing at the time they hit it and do not check back later. i will try to get in touch with you to find out more info.

a hotelheiress promoter lost #1 for a popular term too. his link had promoted an infringing ad for a couple of weeks in july and they whacked it even though it was fine at the time it was removed. this situation is a double-edged sword. we will do what we can to help out.

My conversion rate with xpays is shocking.I have been promoting their paris video for months and still haven't reached the min payout of $150.
I wouldn't be surprised if my conversion rate is something like 1:10000 plus

Seriously? Interesting considering we have almost identical traffic sources.

what is your account number so i can check your account out. we have dozens of webmasters doing better than 1:100 to hotelheiress counting front page clicks. and dozens doing better than 1:300 with lesser quality traffic.

swami- you are sending to the drm and i recommend you use the hybrid ad with the $30 hotelheiress sales and 20% drm payout. you will make 4x to 10x the money

also- for the search pages use:

I had a Hotel Heiress sale today. Fucking yippee huzzah.

My first in two and a half weeks. I've only been sending about 300 a day for the last month or so but it's not converting for shit.

Ah one can only dream of the TCG days of long ago...

swami you were 1:188 today on the drm btw. also i see from your linkfrom(tm) that a lot of your placements are google poland, google russia etc..

anyway- i wish you wrote in sooner as we would have recommended the switch to hotelheiress to boost your revenues like everyone else's. the drm model of trustfundgirls is chargeback-free but low revenue to the webmaster. there are too many variables with the download size etc.. with hotelheiress.com your surfer gets instant gratification and you get lots more money. an average affiliate doing $1000 per month with the drm will immediately be doing loads more xdollars(tm) with the conventional model.

OWEN- SWITCH TO HOTELHEIRESS!

We mailed announcements repeatedly and the ad works way better money-wise!
