    Dutch webmasters: ACCIDENTALLY viewing child porn is illegal

    This might be of interest if you have any sites that you have to review submitted sites/pages for.
    Even if you aren't looking for cp, and don't want to download it at all, you're still punishable if someone submits a link with it that you click without knowing what's on the site.

              De rechtbank is het echter met het OM eens. "Verdachte heeft doelbewust de grenzen van het toelaatbare opgezocht", zo staat in het vonnis. "Hij heeft door het downloaden van grote hoeveelheden pornobestanden, waarbij hij naar eigen zeggen de grenzen opzocht, welbewust de aanmerkelijke kans aanvaard daarmee tevens kinderporno te downloaden."

              Wat een onzin.

                  He got 1.5 years...but this is mainly because they found 1700 xtc pills and illegal guns. Jesus, do this in another country and they lock you up for 20 years.

                          Anyway, how did they find him? I think they werent after him for cp? My guess is he was busted for the dope and they checked his puter and found the cp.

                          As far as i know noone ever in holland got jail time for having 33 cp pics.

                          Only big guys who have and share 1000's of pics get arrested for that shit.

                                  Het vervelende is dat dit een precedent schept waarbij het "bekijken van grote hoeveelheden pornobestanden" genoeg is om je een crimineel te maken. Je hoeft alleen nog maar door een popup/forward op een russische thumb tgp met een enkel illegaal plaatje te komen, en je kunt opgepakt worden.

                                          Yup, maar dat zal niet snel gebeuren. Niemand weet of ik een cp plaatje heb of heb bekeken. Het kan alleen in je nadeel spelen zoals bij dit voorbeeld waarbij iemand voor iets anders opgepakt wordt.

                                                  Yeah, you're probably right about that. Still, this opens up the doors for some dangerous shit - if they want to get you, now they can. Everybody probably encounters cp at one time or another - whether with or without noticing - and because even after clearing your cache stuff can still be re-traced on your hd that makes almost everyone who sees a lot of porn sites "guilty".

                                                  Don't forget that there's also the problem of young-looking models. Since you probably don't have the documentation on random porn you encounter on your computer, a subjective standard of "underage" is used: if they look underage, it is assumed that they are.

                                                      Yes but the question is why would you be a suspect in the first place? You wont. There is no police department who chase people who accidentally viewed porn. Like i said, when it comes to cp they are only after the people who are involved big time.

                                                              Well, my main problem with this is that I don't like being "guilty by default". But aside from that, shit could happen quite easily. Just imagine the following scenario:
                                                              Your computer breaks down. You send it to be repaired. The repair guy watches what you have on your hd, sees some (legal) teen porn, thinks it may be underage (Tawnee Stone?), reports it to the police.

                                                              Now, the police doesn't just check your resident porn collection, they also check your IE cache and your deleted files. So, they could very well find some illegal stuff that you knew nothing about.

                                                              Obviously, a few accidentally downloaded files won't get you life in prison (although they are - rightfully - planning to increase sentences for CP), but it will get you a criminal record, as well as make you a registered "pedophile".

                                                              Now, it isn't at all unlikely that in the future lists of sex offenders, pedophiles, etc will be released to the public for safety. That happens in several countries already, and a number of political parties over here are in favor of doing that here as well.

                                                              So, in a worst case scenario, your life could be ruined just because you see a lot of porn. Unlikely, ofcourse, but a scary thought - and a real one - nonetheless.

                                                                  Het is een tikkie overdreven want het wordt niet duidelijk wat voor straf er nou inzit vanwege die CP op z'n computer.

                                                                  1700 xtc pillen (in India wordt je dan doodgeschoten lol) en een shotgun is volgens mij al voldoende voor die 1,5 jaar.

                                                                  Zoals Bat al zei je moet in eerste instantie ergens voor verdacht zijn willen ze ooit achter zoiets komen. Bovendien als je een beetje snugger aangelegt bent formateer je toch wel een aantal keer per jaar? Wat is nou echt de kans dat er CP op je pc opgeslagen staat als je er niet naar op zoek bent. Die man zat gewoon complete member's areas te rippen.
