that's double jeopardy, nobody will ever convince me otherwise. We set a bad precedent with OJ. Now if the po po can't get you in state criminal, they'll go after you in federal criminal court. If they can't get you in either one of those, they'll go after you in state civil court. Double jeopardy means that once a criminal case is dropped or a person is acquitted they can't be charged again criminally, it is entirely separate from civil courts. Now there is a possibility of a case being dismissed "without prejudice". If that happens then there is the possibiliy of reopening criminal charges if compelling new evidence is uncovered. It's an uphill battle for a prosecutor to get that and if they do uncover "compelling new evidence" they will have to convince a judge that it is strong enough to reopen the case, again, very uphill.

I'm not just talking about the rich and famous. Again, I do agree they're under much more scrutiny.

Imagine that it's your father, or your brother or your son though. Not someone rich and in the public eye. The same rape shield laws apply. Any woman or man for that matter can accuse anyone of rape and they're name SHOULD never be released. The accused on the other hand will be in the public eye, not of his own volition, even if he's innocent.

My point is it's no different than someone coming on GFY and talking trash about someone or someone's business. They can do it under an alias and YOU are then required to defend yourself, even if YOU'VE done nothing wrong.
