Been there. Judge basically told the crown that there is no limit to self-defence and that you can't charge someone with assault for merely defending themself. He went on about the reasoning, but i could give you the case number if you ever need it to show to a judge, :thumbsup

The attacker wasn't a street kid. He was well dressed and sober. We're thinking the girl was a hooker and he was her pimp, because she didn't try to help him fight at all. She just kinda yelled "Ok, that's enough," but she didn't get physically involved.

Elli, a number of people have said this prior but I feel the need to stress this. You have no idea who these people were, age, sex, manner of dress mean nothing. She could be a hooker with aids, he could be a well dressed drug addict with hepatitis or AIDS.

Your husband needs to get to a doctor, clinic or hospital and have both an HIV and hepatitis tests done within the next 24 hours...so i would recommend by noon tomorrow. I simply can NOT stress this enough. He must also make a police report. If it was a simple slap on the face no...but there was blood...his knuckles are scraped...he thinks he might have knocked teeth out...that means the other guy was probably bleeding and there could have been an exchange.

The first test is to prove he never had HIV or hepatitis prior to the attack. Future tests determine if he did contract anything.

You need to do this to protect both your husband and yourself. For instance, if he contracts hepititis from the attack...and you suffer a financial loss because of it...say he can't work for several months.....in Canada we have a Criminal Justice Fund or some damn thing...that means that people who are harmed by a criminal and have suffered financial loss due to injury can make a claim and recover all or a portion of their financial loss.

although i'm no lawyer assault is the charge - self defense isn't something you can plea to a cop, they just charge you ,self defense if a plea in court that can set you free without any record.

Sounds like the guy was probably on Crystal Meth. It makes people loony and it's widely available in the Vancouver downtown core. Very cheap drug but a real hard one to get off of, more addictive than heroin. Lots of crime in Vancouver due to that drug among others.
