Got rear-ended today (car accident)

I was just about to make a right hand turn with a green light and a Honda Civic slammed into me. I was going about 5-10 mph with my blinker on. It was kind of a hard hit but no airbag went off but my modified Jeep couldn?t go anywhere so I got out and saw a Honda Civic sort-of attached to my Jeep. A young girl was on her cell phone crying. I asked if she was okay and she said no. I asked if she was on the phone with 911 she said no; ?I called my father.? I said, I was going to call 911 and do you need an ambulance and her reply was ?fuck-you, bitch.?

I called 911 and told them where we were and the young woman who hit me is not making much sense. Within minutes, the police arrived. Asked for license, registration and proof of insurance and came back asking me what happened. I said there were maybe four cars ahead of me with a red light, the light turned green and cars moved forward and was about to turn right and I got a hit. Police officer asked if my blinker was on? Me: Yes and police officer walks away.

Meanwhile, a tow truck is prying the cars apart. I walk over to see the damage and my Jeep has none but the other car looks pretty bad. The girl is still crying saying that her back is numb. I ask the cops if we could exchange information and let the insurances handle it. One cop said no, so I walked towards my car to get my cell phone and cigarette. I was told not to go near my car.

I looked at the cops and said arrest me because I want a cigarette and to let my husband know that our car was hit from behind and I am running late but I am okay and the car is too. The cop asked where are your cigarettes, I will get them for you. I replied I can get them myself and proceed to do so.

They didn?t arrest me but they issued two violations to me. When I asked why since I know PA laws with modified vehicles and I am up to code? They said fight it in court. Information was exchanged but the girl didn?t have insurance the could not be verified through the State computer system.

I finished my shopping trip not really thinking of the idiot girl who messed up her car and made the phone call to my insurance company. To my surprise, the other party already called stating that I slammed on my brakes and I was issued two violations, and driver is in hospital with neck and back pain. I asked how the violations could be connected with her hitting me. And, stated that the violations were for back tire flares and the front bumper but the car passes inspection as is.

My insurance company said next week they will call and I need to bring in the car for photos. I always thought if someone hits you from the behind, it is his or her fault.

Should I be worried?

No. The cops obviously were siding with the young girl as she appeared to be victimized.

You'll be fine, she hit you from behind.

Make sure you document every thing you state with as much material as possible.
The other driver was obviously at fault but will try to blame you.

This happened to a buddy of mine, he was sued by the driver who rear-ended him. He won, but he had to go through lots of stress until the time the judge issued a verdict for him.

Problem is that there are too many lawers who will take any shit cases and too many judges who don't know right from left and will let a shit case fly.

Nope, I rear ended someone, but only after they cut me off... Left and right lanes were filled, so i could only slam on my breaks and hit them. Insurance said it was 90% their fault.

Even if you had slammed on your brakes, the fact that she hit you from behind just means she was going to fast or following too close. both makes it her fault.

No he said he turned so it could of easly been a yield on green turn

SureFire was 3rd or 4th in line behind a red light, it turned green, she started rolling, so there is no way a sane judge could say it's her fault

you shouldnt be at fault at all, I wouldnt worry much about it...

I actually got rear ended yesterday you can see inside my trunk when its closed now Big F250 whacked me good. It was in bumper to bumper traffic on the highway. Guy forgot to stop

In the area I was in, the traffic lights are about quarter mile apart. I know that the cars moved and I proceeded and tried to make my right hand turn and got hit.

Really, I don't think it is my fault and can't understand why the cops gave me violations and the other driver is in hospital and blaming me. Not a dent in my car and I am not complaining about neck or back pain.

Just seems odd that our stories did not match up and I have insurance.

Surefire the reason you got tickets is for being an ass to the cops when they told you not to go near your car. Just do what the cops say and they usually wont look for a reason to fuck with you.

When dealing with cops, just say yes sir or no sir, answer thier questions, do what they say and never volunteer any information. It will be over much quicker and normaly you dont get fucked with. The wrong thing to do is to show them an attitude.

Great advice.

And when I do something wrong I will follow your advice. I didn't do anything wrong. My cigs and cell phone were in my pocket book along with my with my cash and c-cards. I got out of my car to see if the other driver was okay.

Next time instead of reacting to a situation, I will think about myself....Hope there isn?t a next time.
