SEXUALLY-EXPLICIT: Email messages now illegal

....without the proper warning/words in the subject line and "brown paper wrapper area". And without a mailing address. this is fine and dandy..but what happens if your account gets hacked and the hacker sends out sexually explicit spam messages from your server for months without you knowing it until one day the police or FBI is knocking at your door?

the government is beginning to squeeze hard on our freedoms...and it sucks...i feel like every which way i turn there are more and more restrictions on our freedoms nowadays.

Yes, I'm quite aware, but if someone lets something like this go one for months and is unaware, then he shouldn't have a server.

As you know, the United States Congress recently enacted the CAN-SPAM Act ("the Act"). As directed by the Act, the FTC has just issued its final Rule to prescribe a mark to be included in all commercial electronic mail that contains sexually oriented materials.

The Rule is scheduled to become effective May 19, 2004.

Following are the requirements of the final FTC Rule that you must comply with when sending sexually oriented email to promote our products:

1. The exact phrase "SEXUALLY-EXPLICIT:" must be contained in capital letters as the first 19 characters at the beginning of the subject line. This phrase in the subject line must be in ASCII format.

2. The exact phrase "SEXUALLY-EXPLICIT:" must be in capital letters as the first 19 characters in the "brown paper wrapper" area of the email message. The Brown Paper Wrapper refers to the opening portion of the e-mail that is immediately visible to the recipient, without scrolling down or taking any other affirmative steps to view the message. Sexually explicit material can be displayed beneath the "brown paper wrapper" area of the email message or accessible by clicking on a link.

3. A valid postal address must be displayed in the "brown paper wrapper" area of the email message.

In addition, the "brown paper wrapper" area must indicate that the message itself is an advertisement or solicitation, and contain an e-mail address that the recipient can reply to declining any further commercial e-mail messages from the sender.

4. As CAN SPAM covers both visual images as well as the written word, the subject line must not contain text with written descriptions of Sexually Explicit Conduct. Also the "brown paper wrapper" area of the email message must not contain Materials with Sexually Explicit Conduct. Sexually Explicit Conduct means actual or simulated sexual intercourse [including genital-genital, oral-genital, anal-genital, or oral-anal, whether heterosexual or homosexual]; bestiality; masturbation; sadistic or masochistic abuse; or lascivious exhibition of the genitals or pubic area of a human being.

5. Violation of the CAN-SPAM ACT may lead to civil and criminal penalties. You should seek proper advice from a qualified legal specialist. All violators will be terminated from the program in accordance with the terms and conditions and we reserve the right to report violations of the Act.

i'm not just referring to the adult industry...there are so many small businesses that have websites that have no idea what they are doing and don't check logs. adult and mainstream.

Quite true. My opinion applies to them as well. I've had an unfirewalled hahahahahahas 2000 server out there for 1.5 years or so, and I haven't had any security issues to date. As long as you keep your shit up to date and proactively secure things, you'll be okay.

You don't have the freedom to spam. This is incentive to keep your systems secure.

I applaud the government for this effort , although I think the law is very weak overall. I hope the FBI/FTC does come knocking on GFY members who spam and profit from SPAM like SPONSORS and WEBHOSTS who are ALSO liable....

some of you are misunderstanding and thinking i'm for spam, which I am not....i agree that the government should do something to stop spam but i just think they are going about it the wrong way...which can cause alot of headache for alot of innocent people...they should be concentrating on getting rid of spam from a technological standpoint...like validated email addresses, etc.....not by these small rules and restrictions they are putting on the messages themselves
