WASHINGTON - The recording industry sued 477 more computer users Wednesday, including dozens of college students at schools in 11 states, accusing them of illegally sharing music across the Internet.

The recording industry filed its latest complaints against "John Doe" defendants, identifying them only by their numeric Internet protocol addresses. It said lawyers will work through the courts to request subpoenas against the universities and some commercial Internet providers to learn the defendants' names.

The latest filings brings the number of lawsuits filed by the recording industry to 2,454 since last summer. None of the cases has yet gone to trial, and 437 people so far have agreed to pay financial penalties of about $3,000 as settlements.

Here's a question.


I've probably bought every single Metallica record ever made. Some several times, on different mediums. This includes box sets, everything.

Now I'm not really a big Metallica fan per se. I just listen to music from across a broad scale of genres. I've never been a collector, and as I travel quite often, I don't keep a lot of stuff. Most of the CD's I've bought at one time or another are god knows where.

Now .. I have probably every Metallica song downloaded, from the internet, on MP3. Am I a bad person too, even though at one time or another I've already paid for all of the albums?

I hope Metallica doesn't starve! Naughty file sharers.

my problem with what the RIAA is doing is, I can't see how this falls under copyright infringement.

No one is making derivative music from anything they have, and no one (in the general group we're discussing) is trying to profit from the sharing. They're simply sharing. For free.

If someone is burning CDs and selling bootleg copies at a swap meet, sure... blatant, obvious, copyright infringement for profit. But how does sharing your CD (non-profit) with a friend constitute copyright infringement? Because they didn't PAY for it? I find that hard to swallow too. If I feel like it, I'll box up my entire CD & DVD collections and give them away to whoever the hell I choose. Is that also "copyright infringement"?

I think not. But that is what the RIAA is claiming, in a nutshell.

Arguably they could say "one copy - one license".

When you box up your DVDs and CDs and send them to a buddy .. They are now completely in his possesion. If you want to watch them again, you'll need to get them back. Failing that, you'll have to buy them again.

When you share music on the internet, you are really just making a "copy". If by sharing the song, it was removed from your hard drive completely, it might be a different story.

I think there was a study released recently that said music sharing is NOT hurting record sales. Don't know what study it was though.

What if the persons computer was hacked and the hacker is unknowingly using their server to share files?

Damn near everyone has viruses/spyware these days.

If the RIAA won a lawsuit like that, then it would set a precedent where users would actually be liable for the damage/s their computer/s do regardless of their knowlege or participation of the malicious events.

Then sys admins could start suing people for not keeping their shit up to date and being naive enough to open unexcpeted file attachments

In fact, I would go so far as to say that SELLING your CDs to a used CD store constitutes a better claim for copyright infringement than GIVING it to someone. In that scenario, you are actually RESELLING their copywritten material, and they are NOT receiving a cut.

So, why is the RIAA not suing every used CD store in existance rather than filing thousands of bullshit lawsuits against their own customers?
