Would you consider this to be theft?

Imagine this scenario:

You send a few signups to a few sites processed by the same company.

Several of those signups chargeback.

The processor suspends your account and advises you that you cannot process transactions through them while your account is suspended. In other words, they're telling you to sending traffic to their sites.

If you continue to send signups after being told not too, would you expect to be paid for them?
And if they weren't, would you consider it to be theft?

actually, i'm just trying to prove a point to a stubborn idiot who believes with all his heart that it's theft if he doesn't get paid for signups sent after he was told not to send anymore.
