Two ICQ chats I had with Acacia licensees.

Had another licensee on ICQ yesterday who was asking if I could lighten up in my condemnation of them. My answer was no both times.

Neither could answer a simple question;

"If you had thought by signing you would go out of business would you have signed or fought?"

I do feel sorry that they were placed in the position where they had to make the choice, but until licensees and more importantly potential licensees know that signing up is a bad move we will be plagued by more "Patent License Firms"

Licensees are the way Acacia fund themselves to screw more of us. Cut off the supply of funds and you starve the foe, feed him and you make him stronger.

Neither of them would contribute to the defense fund saying it was against the terms of the license.

So we are to keep sending business to licensees while they pay a little license fee and others do the fighting (paying) for them.

No I will not let up on licensees.

update on the case from perspective of a webmistress who retired for 6 months then came back:

Late 2003: everyone hates acacia - fight to death stuff!!!
Now 2004: come back and most big players have signed leaving smaller webmasters to fight what now looks liek an uphill battle


but liek i said - i been away 6 months - but thats how it looks from here

Youre right, as soon as a major player like playboy caves in, its all over with. WMs serving video are eventually gonna have to pay. Get used to it, I dont think its gonna go away.

However there will be many; like myself, who say; Fuck Acacia and fuck getting extorted. We will build a new comprable platform with no lic bullshit.

It just adds more fuel to their fire with these companies caving in.If they all pooled their resources to fight them ,then we would have a better chance to defeating them..either way it sucks

I agree with you 100%

well the way I see it is liek this:

the big players side up with acacia because what happens is all the small webmasters get left to fight the patents
the small guys dont have the money or resources or whatveer and they go down fighting - it leaves the big boys to make MORE $$ that the small webmasters once used to get.

basically it's just combing thru the industry and gettign rid of the "loose fluff'

the big players can afford the patents - so if it' going to knock off some of the competition - then why the hell wouldn't they sign?

personally i dont agree with this whole acaia / patent thing BUT I CAN see it from their (the big players')side - as a purely business point of view
And LETS NOT FORGET - they are in this biz to make $$ not friends

Ithink the patent will be defeated in court, otherwise a really big player like MS would of stepped in and crushed it.

Just the licensees took the easy way out and want others to pay for defeating it. And they want all of us to support them while they sit back and do nothing.

We as an industry are doing little to support the Homegrown, Lightspeed, etc. so why should we support Hustler, Epic, Matrix by giving them business and sending more money into Acacia's coffers?

Those that Sign LOSE.

No way that Patent claim holds water...

Once ya sign your bound to it and will pay license fee's regardless of the patents defeat

I am tempted to open a video site and have ACACIA come in and shut off my Streaming video by court order then when the Patent is over turned file a fucken lawsuit for big time monetary damages to my business that was destined to make it big time.

I hope so, once the dust settles is when another fight will start.
The fight that puts them out of business settling suits that damaged hundreds of business ability to make money on the net.

Think about the losses them guys can claim in damages...

I really wish I had alot of money, I would be laughing my ass off knowing that in due time I would stand to make a 20 fold fortune off a small minimal investment of a video site!
