If you hit a pothole and fuck up your car, can u sue the city?

The roads in Toronto are just horrible! There are potholes everywhere!! I was wondering, if you were driving a very low sports car on the highway at bout 60mph and hit an imperfection in the street, could you sue the city for the damage?

their are not liable for damages from potholes but they are responsible for taking care of them.

in montreal you cant, they passed a law 10 + years ago to protect themselves against it.
good thing too cause here we have the worlds largest potholes, not to mention that all our roads seem like they have never been paved correctly to begin with and just keeping worse as the cold winter makes them detteriorate

it actually depends on what state you live in, I know michigan and CT WILL pay for damages in most cases, can't speak for other states, best bet is to check with your local dept of transportation to find out for sure

Law school has done me well

depending on where you live, the city and state pretty much have the word on what you can do. Now for places where you can take legal action towards the city they have some very short timelines where you can actually file. Usually city and gov organizations have the shortest period where you may take action, while people and business have longer periods. If you want email me at [email protected] with where you live and I might be able to get ya the info you will need.

I know the city I live in you have 72 hours to file, amazing isnt it

You could turn in a written complaint and city will investigate and give you a settlement only if they believe if it was negligence on their part ie. the pothole wasn't created by the bad weather last night. You could go to court if you weren't happy with your settlement but nobody ever did so can't tell what the outcome could look like.

I believe I read in the news a few weeks back that motorist sued the city for the damages to his car because of a pothole and won in Montreal. But tons of people were starting to do this so now you have to deal only with your insurance company.

The potholes there are NOTHING compared to the ones in Montreal.

well my mom's new Acura got dinged by an errant shopping cart in the parking lot a few weeks ago... she just sent me an e-mail saying the store agreed to pay for it and cut her a cheque to the name of the car dealership for the amount of the damage estimate...

I hit a pot hole and bent the right rear wheel on my corvette, my attorney said all i could do was call the county road department and complain but that filing a case over it would be a waste of time. Make me wonder where the money goes when you register your car.

Sue them, you pay taxes for this stuff it's their responsibility to maintain the roads unless they give up that duty to the citizens. Therefore, sue them for every buck you can to get your car fixed.
