LOS ANGELES, Calif. ? Word has emerged from a Monday court hearing that hotel heiress Paris Hilton not only made her porn debut in the sex video of her and ex-boyfriend Rick Solomon, but that she also got her footing as a first-time director.

According to federal court papers filed by Seattle-based Marvad Corp. in response to a $10 million copyright infringement lawsuit filed by Solomon, Hilton played a major role in directing and shooting the video that is now being considered one of the hottest sex properties in Internet history.

Court papers are also claiming that simply based on the level of Hilton's participation in the tape's making, by default she is the co-owner of the copyright and that Solomon's failure to identify her as a "co-author" on his application for copyright registration renders the certificate invalid.

"So far the judge heard the case and is now trying to determine if he [Rick Solomon] has a valid copyright," Kevin Blatt of KB Consultants, told XBiz. KB is the public relations firm hired by Marvad. "This is definitely getting interesting and it is far from over, believe me."

Marvad is asking U.S. District Judge Dean Pregerson to dismiss the lawsuit filed in November by Solomon based on the fact that Hilton's involvement in the making of the tape was not revealed by Solomon.


"Ms. Hilton offered directorial comments and physically controlled and directed the camera," Marvad claims. "Including pushing partner Rick Salomon aside so he wouldn't block a frame."

Monday's court news came as a surprise to many parties involved in the case and other lawsuits that resulted when the tape was acquired by Marvad via Don Thrasher, an ex-roommate of Solomon's, and released over the Internet.

The court papers also lent a blow to Hilton's lawyers who have so far contended that the young heiress was drugged and manipulated into appearing in the sex video.

Solomon has only recently stepped forward to claim ownership of the tape via several public appearances and through his brother Jim, both of whom have launched a website, TrustFundGirls.com, with the express interest of marketing the sex tape for $50 per download. Solomon has unabashedly admitted that he feels the sale of the tape over the Internet, in its digitally remastered format, will make him up to a $100 million.

"We bought the tape through Thrasher and he represented all along that he was partners with Solomon, but then Solomon claimed that it was stolen, and now here he is coming out with his own tape," Blatt told XBiz. "You would think any judge in their right mind would just throw the case out."

Also at issue is whether or not Hilton was over 18 years of age at the time of the tape's making. Hilton herself has not come forward to state otherwise and no documentation proving her age has surfaced, according to reports. Hilton has also not sued Solomon over possession of the tape.

"In my personal opinion, there's got to be a level of involvement on her behalf," Blatt said. "You cannot legally show this tape unless you have two people's consent. Something just doesn't smell right."

There are also reports filed by Marvad that Hilton was aware that Solomon was showing the video to friends, the New York Daily News reports.

Solomon's attorney reportedly dismissed the argument as "great for the media, bad for the law."

"My client owns the video," the attorney told Reuters. "When an actor appears in a motion picture and may help direct scenes ... that doesn't change ownership."

Rick Solomon was unavailable for comment at the time of this printing.

XPays Gets A Piece of Paris


SAN FRANCISCO, Calif. ? Now that Rick Solomon has come clean and revealed his true role as the mastermind marketer behind the Paris Hilton sex video release, the former ex-lover of the hotel heiress has made it abundantly clear that he not only owns the rights to the infamous sex tape, but that he fully intends to make millions from its circulation.

After setting up website TrustFundGirls.com with his brother Jim in recent weeks, Solomon has signed webmaster affiliate program XPays to share in the promotion and profits from what is being called one of the most downloaded sex videos of all time.

The newest marketing spin on the tape is that the picture quality has been vastly improved and now includes leading edge Digital Rights Management (DRM) technology to prevent piracy and retain the integrity of the tape's copyright ownership, which according to Solomon is his and his alone. And so far, no one is contesting that claim.

"We're very confident that not only they [TrustFundGirls] have the rights to authorize the use of the tape, but that they have the rights to go out and enforce those rights,' Evan, co-owner of XPays, told XBiz. "Everything being done completely above board."

According to Evan, XPays holds the exclusive affiliate marketing rights with TrustFundGirls and no tracking or commissionable link will go to TrustFundGirls via any other network.

XPays signed the deal over the weekend following negotiations last week first for TrustFundGirls' exit traffic and then to include the tape as a new product in its webmaster affiliate program.

The tape first surfaced in November 2003 when an ex-roommate of Solomon's, Don Thrasher, sold a bootlegged copy of the tape to Marvad Corp., owner of SexBrat.com, which set off a flurry of lawsuits between Thrasher, Solomon, the Hiltons, and Marvad, most of which have been dropped, according to reports.

Since its original debut, the famous sex tape has been expanded from its original 28-minute format to just under 38-minutes and includes new scenes.

According to Evan, approximately 15 minutes of high-resolution color footage has been added and the rest is shot in high-resolution black and white night vision.

The tape has been re-mastered from the original copy, which all the while was in Solomon's possession, as opposed to the grainy, low-resolution copy that fell into Don Thrasher's hands and was circulated over the Internet. The inclusion of DRM technology and a sophisticated tracking system will ensure that all errant copies of the tape lead back to the original webmaster and copyright holder.

"DRM has all kinds of neat security aspects," Evans told XBiz. "Even if it is put on peer-to-peer networks, the user cannot play the video without purchasing the download rights. We're tracking the DRM purchases back to the webmaster in all cases and to the best of our technical ability. If people want to file-share or burn it on a CD, their friend won't be able to play it without paying for it."

Evan added that XPays is offering a reoccurring payout on the sale of the tape and that webmasters get a cut every time it gets a repurchased. All revenue share will lead back to the original webmaster, Evans told XBiz.

Rick Solomon has not been shy in admitting that he estimates his new Internet video venture will reap in around $100 million, based on a $50 download fee, which users can access five times over five days. Although it remains unknown if Hilton herself has a hand in the venture and whether or not she too will profit from the mainstream release of the video.


"This is a new product and a new component for us and we are gearing up to use DRM revenue share to augment all of the available stuff that is out there and make sure we supply our webmaster clients with the most modern technology available to distinguish us from other affiliates out there," Evan said.

Evan also added that according to his knowledge, Solomon and his company fully intend to enforce their copyright on the sex tape by shutting websites down that are marketing pirated versions. Several sites have allegedly already been shut down for that very reason.

But according to Evan, the Hilton/Solomon tape is not the only sex tape his company is looking to secure.

"We are actively looking to add more and more different varieties of tapes and more TrustFundGirls footage," he told XBiz.

In explaining how XPays won the deal, Evan told XBiz: "We explained to TrustFundGirls about our software and our technology and that we felt that their choice to provide the tape in DRM format was genius and that we wanted the opportunity for our webmaster to promote the video. They saw the light.'

"Earlier this month the Hilton legal team launched a $30 million lawsuit against Kahatani Ltd., a porn purveyor based in Panama, claiming that the company illegally distributed the famous videotape of Hilton and Solomon having sex.

Hilton is also in the midst of signing a book deal with Simon & Schuster for an estimated $1 million to co-scribe a tell-all autobiography titled "Tongue in Chic: Confessions of an Heiress."
