Stay Away From Wegcash

Some of you guys might already have heard about the controversy.

I am the webmaster they screwed up , the sum of the fraud was about 5000$ usd , for absolutely no reason, here is the complete story.

I am a Big gallery maker, I have over 4 years of credibility in the business and get over 1 mil per day on my galleries. Very possible that you guys didnt hear of me because I dont hang around on boards and dont own any big sites.

I started promoting Wegcash.com about 4 months ago and every thing was going fine until about 3 weeks ago when I got an email from GABE saying my account was cancelled without pay. I immediatelly call them and ask wassup , here is the reason they gave me for not paying me 5000$

"you are telling the surfers that they might cancel their memberships once the trial is expired".

And I admit I did. This was for the EZpass program to which I sent 10 signups 3 months ago when I was still experimenting with wegcash.

But the thing is that in the last month I sent over 4000 4free sign ups all coming from pages where I never told any user that they have the right to cancel their membership, and those are the ones they refuse to pay me.

You find this fair ? Tonda , Gabe , Jason ....you fucking find this fair ?....

The only reason you haven't heard of me for the past 2 weeks is because I was on vacation, but trust me now I just got back and I'll make sure Im the last guy you screw up like that.

This is not something you do to gallery webmasters, everyone knows how hard it is to make a buck with galleries.

Anyways, for me its no big deal, I could live without those fucking 5000$ but I'll get justice in the end, that's what matters.

When you start making money they'll fuck you....thats the only guarantee you have with them.

Ok so you admit you broke a rule? If it's a rule that is. Not sure don't use them but most per trial programs don't take too kindly to telling your surfers to cancel after they sign up.

i promoted them some weeks with a TGP

join 4 free program was making 50/60$ per day

and my account got Banned.

I contacted them and they had no good reason.

the checks i got where still working tough so i didnt loose any cash

but i agree they fucking suck

You cheated their program. You're a cheater no matter how you try to justify it. They have every right to can you and deny ALL PAYMENT.

Rule #1: Don't try cheating programs. They WILL find you.

After 4 years in this industry, I would think you already knew this.

1. its the right of the surfer to know that they are allowed to cancel their membership after the trial is expired.

2. Its nowhere to be found in the rules that this is not allowed, in my 4 years , I've done times and times again.

3. We are talking about 5000$ legitimate dollars that they didnt pay me, you give a warning before banning a user with that much traffic.

Get all of your paperwork, statistics, and emails together and sue them in small claims court. If they don't show up, the judge will rule automatically against them.

When people don't pay, I sue them in small claims.

Your admitted violation is small potatoes and is not an excuse for cancellation well after the fact of the abuse. The abuse in percentages was minimal. Based on what little information you have gievn, you have a pretty good case.

Of the 5 times I have sued in small claims, 3 times the defendent didn't even show up and I got a summary judgment.

Don't post about this on any more boards, delete what you have posted, and immediately file.

I'm just wondering how you expect them to stay afloat if they pay you $33 per sign up for someone that is going to sign up for a free trial then cancel before they pay anything.

I've been receiving cheques from them for a long, long time.

Maybe you have a point about that not being in the TOS, but I would expect it to be almost common sense that you shouldn't be able to market their sites like that. (telling people to cancel)

Telling surfers that they can cancel a trial before it turns over to full membership is just educating them about the billing process.

Common sense, yes; the same common sense should tell any per-signup program to state it in the TOS.
Besides, not paying for 10 * $33 signups is a bit different from not paying $5K, is it?

You admit that you violated our terms of service. You admit that we emailed you. Here is just a section of our TOS:
"The term of this Agreement will begin upon our acceptance of your Affiliate Program Application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party notice of termination. Notice by e-mail, to your e-mail address on our records, is considered sufficient notice to terminate this Agreement. If this Agreement is terminated because you have violated the terms of this Agreement you are not eligible to receive any commission?s payments, even for commissions earned prior to the date of termination."

You agreed to this when you signed up for an account with WEGCash. We did not screw anyone over all we did was follow the rules. See an additional section of our TOS:
"You may not...engage in any other marketing activity which is intended to create a signup which is not completely voluntary and made on a good faith intent to become a member of our site(s)."

Now do you think this site was following the rules?

Yea you're right some webmasters have to have every hundreds of various ways to cheat posted in a TOS in huge bright red letters and also have someone call them every day to remind them of this. Almost everyone knows on per trail sign ups you can't tell surfers to cancel the trial before it ends. Just like almost everyone knows you can't tell them they will never be charged or other bullshit like that. Old tricks repeated by cheaters time and again since per sign up gotr big. This is just a common rule in per sign up. You don't see signs hanging every where you go that say don't kill people do you? You just know that if you do you are fucked.

What exactly was he in violation of though? What part of the terms can you say he violated? I think that's the issue.

If you are saying you've got the right to terminate the agreement at any time for any reason, and keep all payments owed, guess again.

That would never stand up in court, and in some cases it's probably illegal.

exactly, those programs have to make money as well. no affiliate should encourage surfers to cancel a trial membership before it rebills.

I'd say looking at the screen cap above that the part of the page that says, "cancel the membership once you're finished jerking off that way everything is free.."

2) You may not coax a surfer to become a member. It must be 100% voluntary on their part.

There is nothing there having anything to do with what this guy did.

For the record, I don't agree with exactly how he did what he did.... But you should be able to educate the surfer about the billing process in general.

Again, he was not creating signup's that were not completely voluntary. That much is for sure. These people were becoming trial members on their own will. So he wasn't against that part of the TOS.

"and made on a good faith intent to become a member of our site(s)" is the key line here. This is what makes or breaks this issue.

The problem is that even trial members are considered members. So this part can be looked upon as basically saying "Surfers must be intending to become a member, full or trial."

Yes, paysite owners want trials to renew to full memberships. But the fact of the matter is that 3 day access (or whatever it is) is being provided with an option to cancel.

So how can signing up with the intent to cancel be considered a bad faith signup when the paysite clearly offers this as an option?

Hey I ran across one some time ago, this one is real good. The person was paying people to sign up to a per sign up program think it was $8.00 per.
Told'm how to cancel, they had to email him/her the sign up info.
The per sign up program was for $40.00, netted $ 32.00 each sign up. My 1st thought was fuck the shaving prick's, in the end I emailed them, never even got a thank you, so next time it is Fuck'm, and that goes for most sponsors any more.

You could call me cheater or whatever you want....Of course the company is gonna defend themselves someway or the other, But in the end if you Read my original post carefully you'll figure that there is obvious injustice.

Tonda if your program is so great ...why did you hang up in my face ?...why did you pretend to be in a meeting for 1 week ?...if you dont want to pay fine....why are you still using and selling the double confirmed emails I sent you ?

He/she... told them they COULD cancel ....

The difference here as I see it:
1) Maybey he was trying to use some good marketing strategy here.
2) his only responsability is to get the person to the site right?
3) the sponsor is responsable to have a good enough product to get the sale, and the retention! (is that his fault too)
4) one could argue that he was telling the surfers their rights, in an attempt to let them know that they WILL NOT be decieved by his site, and that they must only pay for the services, or products they are happy with not get hooked for the extra!
6) I realize that this is the norm... but I see a lot of warning signs that scamming will not be tolerated... maybey he was ahead of his time by doing this.
7) Look Visa is so torked by the scam operations, and excessive charge backs that they have to deal with daily, costing them millions....(you think this had anything to do with them making it so easy for us now)?

The problem with all of the new einstiens in this business, is they always want to find a way to cheat a little extra instead of good ole fashioned hard work, good products, and wow imagine this one...customer service..
