For the most part and to a limited extent, verbal contracts are just as valid as a written contract. I digress on that point. As for him being slick and hiding his money, this does indeed present a huge problem. But, you can make his financial life miserable. If you were to win a claim against him, he will be unable to open accounts in the US, make transactions, investments, get paid from US companies,get credit, puchase property or large ticket goods. His financial life in the US will be frozen. His only option would be some type of bankruptcy in the US courts, which I'm not sure is an option to non-citizens. If you can't get your money, you may as well make him as miserable as possible because of it.

I was a 50/50 partner in a project, xpass.com. I was the $ guy, other partner was doing the nuts and bolts. Project was very late and not up to par, so I pulled funding in an attempt to gain more input into the product. Other partner went to Vanderpool who simply started funding the project in my place, yet I still owned 50%. He then called me and said "brad I have been funding xpass, I understand you own half of the project. How about I give you my word you will get your $100k back from me, and allow me to proceed"


From what I understand the entire project later on failed. I warned David what he was getting into to. But he told me regardless, I would get my $, I had his word.

I said ok.

Yeah, that is unusual for ventures this large to not have anything spelled out in writing. I wonder if people are just more trusting of each other in this industry.

The situation was pretty complex. I was having problems with the original partner, and started to pursue legal options with my lawyer. Then David came to me man to man and basically said that he would take this problem off my hands, and pay my back my investment. We had a gentleman agreement, and I left it at that. Hindsight is 20/20. At that time, his word was good with me. I obviously know he can afford the $100k out the ashtray in his Volvo.
