I agree. All this STOPS are the legit bulkers cuz now if they follow the law their lists are easy to opt out of plus they can be blocked at the server level cuz they label their subject lines.

Like I said in another thread, all this will do is make email advertising easier to detect, block, and filter.

Those that operate using socks/proxies/"non existent" domains/bulletproof mailers will continue.

THE REAL ACTION THIS LAW HAS is that it allows the government to crack down on SPONSORS who knowingly use affiliates that hide their tracks.

This is the provision that will allow for more efficient filtering of ADULT bulk mail. Again, its the guys who comply that get the ass raping

(d) REQUIREMENT TO PLACE WARNING LABELS ON COMMERCIAL ELECTRONIC MAIL CONTAINING SEXUALLY ORIENTED MATERIAL-

(1) IN GENERAL- No person may initiate in or affecting interstate commerce the transmission, to a protected computer, of any commercial electronic mail message that includes sexually oriented material and--

(A) fail to include in subject heading for the electronic mail message the marks or notices prescribed by the Commission under this subsection; or

(B) fail to provide that the matter in the message that is initially viewable to the recipient, when the message is opened by any recipient and absent any further actions by the recipient, includes only--

(i) to the extent required or authorized pursuant to paragraph (2), any such marks or notices;

(ii) the information required to be included in the message pursuant to subsection (a)(5); and

(iii) instructions on how to access, or a mechanism to access, the sexually oriented material.

(2) PRIOR AFFIRMATIVE CONSENT- Paragraph (1) does not apply to the transmission of an electronic mail message if the recipient has given prior affirmative consent to receipt of the message.

(3) PRESCRIPTION OF MARKS AND NOTICES- Not later than 120 days after the date of the enactment of this Act, the Commission in consultation with the Attorney General shall prescribe clearly identifiable marks or notices to be included in or associated with commercial electronic mail that contains sexually oriented material, in order to inform the recipient of that fact and to facilitate filtering of such electronic mail. The Commission shall publish in the Federal Register and provide notice to the public of the marks or notices prescribed under this paragraph.

I have had a few major non-adult companies send me mail asking me to reconfirm my memberships to lists or sites that include member's mailings. The funny part is that most of them DIDN'T confirm me the first time, just accepted whatever BS some jackass typed into their collection boxes.

Spam without faked headers, misleading subject lines, and such will be MUCH less profitable. Without faked headers, many spammers won't be able to operate, as they will be shut down VERY quickly as a result of being traceable. That is the theory, anyway. In reality, if the spammer is from anywhere outside the US, they don't have to comply. Remember, it's US law, not WORLD law.

Oh well.

As for adult filtering, this is the same concern I have with creating an .XXX domain registry. I would be so easy for an ISP to block out ALL adult material. Imagine AOL with an adult filter turned on by default, requiring that the member call an 800 number and talk to an operator to have it opened up. Porn online would be DOA within a week.

Since we have to use AOL at the hotel we're staying.....they have already published the ten most common subject lines, which they have, by default, already filtered out.

It seems funny that they seem to push most of these laws in the direction of porn, but I get about 5 times as many insurcace or mortgage spams as I do adult.

Someone said in another thread, and I dont know if it is good or not, but they said that only 14% of spam is adult.

I think that it would be closer to about 30%, but that is still pretty low in the total view.

That's true. But they probably single out porn since people have an instant gut reaction to it. More palpable than, say mortgages.
