Speeding Ticket Question

The tickets I've gotten before were for like 20 over so a lower ticket is new to me...anyways, I've got one for 1-10 MPH over and I've always heard these don't hit insurance so I'd rather just pay then go to traffic school. Is that true?

Figured I'd double check here because my insurance loves to dick me over any chance they get

Hmm.. must be location specific.

I've paid fines and had to go to court over speeding tickets, but never even had the option of traffic school.

never pay for any traffic tickets

always go to court and plead not guilty

even if you don't have representation you have a 45% chance of the case being dismissed just because the officer that issued you the ticket does not appear in court

Well it was knocked down a few miles to make it a 1-10 so I'd rather not take that chance...it's only like a 100 bucks anyways. If I go to court I have to go to arraignment, the court date, etc.

Do you have to attend? I know that in the UK if you DD you have an option to attend sessions to help you over come you adiction and learn about how many units are in each drink etc.

It costs about $20 to process all the paperwork and other such stuff that goes into a ticket. That leaves anywhere from $30 to $180 in pure profit for the traffic court. Where else in can you find such an incredible profit margin? BUT...if you do "the unthinkable" and fight the ticket... BOOM! the profit margin is completely shot. If just 1 in 5 people actually fought their tickets, traffic court would become so expensive to "run" that the government would be forced to discontinue traffic court in approximately two months.

No its optional for people who are trying to keep the points off the record and keep their insurance from finding out.

Shouldn't be an issue though since my ticket's only 1-10 which I'm under the impression doesn't get reported to insurance.

Those were the good old days. When we were younger we would always be crossing our fingers hoping the officer wouldn't show up. Now he doesn't need to. I guess this would all depend on your location and the laws in your jurisdiction but that trick no longer works in NY.

I would still go to court though. You can usualy get it reduced to a non moving violation if you smile and act sorry. Sometimes they automaticaly assume thats why you are there and reduce it right away.

Well its pretty much at its lowest point as is...getting it reduced fifty bucks or whatever isn't worth the time to me.

I just want to make sure it doesn't hit my insurance.

I did it years back to plea down a 31 over ticket and I still had to pay a bunch of fees plus like $25 for the school, not to mention my lawyer. The ticket itself would've been cheaper just to pay, but I'd hate to see my insurance after that.

As far as insurance goes, my sister-in-law works for an insurance company and she said that if you get a ticket, it's best to not make any changes to your policy because every time the insurance company checks your record, it costs them like $8 I believe, so to them, they're not gonna check your record if they don't have to, however, some places do random checks, but most cases, they'll never find out unless you change something on your policy.

Some states like california allow you take your traffic school over the internet. Basically you go online and answer like 10 easy questions and your done. But If your ticket is only 1-10 miles over Id go to court. Generally these are thrown out. Ive sucessfully beat several traffic citations. Usually by claiming it was a busy street and the officer must have mistaken which vehicle he radar'd or that a truck was passing me and he must have got the top of the truck skewing the reading.

There is usually no arraignement etc as its a civil infraction not a criminal case. And if the speed was lowered by the officer and not the court he won't show up anyway as he is not going to want to explain to the judge why the reading on your ticket does not match the radar.. one could assume he was not confident in the reading and made up his own.

also If your previous ticket was over 6 years old it won't come up.

Insurance always comes back to bite ya in the ass! Used to have a radar decteor and a lead foot when I was younger. Now I just figure it's cheaper to drive right around the speed limit. Haven't had a speeding ticket in quite a number of years.

Here in the Dallas area, if we get a ticket, you can go to Blockbuster (of all places) and rent this traffic school video and watch it (or not). Then, bring it back to Blockbuster and submit the form that you watched it and the ticket will be dismissed.

Here, you can goto your court date on the ticket and ask them for the school. If they accept, then the ticket won't show up on your record at all.

Here in Florida you just pay a lawyer 100.00 bucks and they go to court for you and you don't have to attend school and NO points are put on your record. The very worse case scenario is paying a small fine on top of the 100 bucks you pay the lawyer.

how can there be a court case if the crown prosecution does not have a witness?

and who does the defense attorney cross-exam if the witness does not have to appear in court?

doesn't sound like much of a legal system to me in NY

To insurance companies a ticket is a ticket no matter what the speed or fine. I would contest it and if that fails do traffic school.

I just got a ticket my self. I have not even looked at the amount yet, but I have the option of online traffic school and that is what i am doing. For one reason only. It is a 3 hour drive to go to court. And I would have to go 2 times. That makes it not worth it..

If you go to court you have a 50/50 chance of winning. If you were caught with Radar, and you were on an expressway, you can claim that there was a tractor trailor passing you and the the officer must have clocked the truck. Somply because Radar is not targeted. It goes for the biggest object. If nothing else the judge may withold the points, and the INS company does not find out.

If the officer does not show up just ask for it to be dismissed for lack of prosecution. ( did I spell that right?)
