As far as the courts decisions go.. it isn't a matter of adult industry.. mainstream industry.. yada yada..
It's a matter of infringement validity or not..

If Acacia loses.. it becomes a moot issue.. If they win, then the 'adult industry' also becomes a moot issue and it all becomes an overall infringement endeavor.. be it adult, news sites, video chat, etc..

if you look at homegrown videos copies of the legal documents

Acacia admits it is not about only the adult industry
However they fought any removal of the nature of the videos being broadcast Ie: adult and sexual and a few other words. in order to persuade the jury in their favor i imagine

there stock has went down from over 8.00 to low 6's in just about 3 weeks.

they are due for more press releases to prop up the stock... they have nothing to lose and everything to gain.

Exactly and I think Acacia's case against them is even weaker than it is against websites. They are fucked.

if you think ANY of the big players in adult settled for numbers like that you're on crack.

acacia gave them SWEATHEART deals to get their names to scare other people into settling. a few thousand each TOPS - how do I know this - look at acacia's financials. no big income came in.

acacia's panicing now and grabbing at anything it possibly can cause it looks like they will loose the homegrown battle.

I wouldn't say they are "panicing" they are calculating...

Look at v-chip....they racked up $27M in licensing before it got knocked down by Sony....did they cry in their wine about it? No, they moved on to the next patent...ala DMT.

They will try to rack up licenses with DMT... When it gets invalidated, will they cry in their beer? No, they will move on to the next patent.

Getting the picture here? Pick on easy targets to roll over...that will fall into the "easier to keep her, then leave her" idea.

Mainstream is so fragmented, that OnCommand will most likely settle, when faced with $1M+ in legal fees should they fight this themselves....mainstream acts like individuals... i don't see them really banding together like the 11 defendants....

This is why i believe Fight the Patent Foundation is needed...to act as the center point, that companies who are hit with a particular patent abuse case, can connect to and fight together.

Atleast with the adult industry, people do communicate with each other and post messages on boards, make comments, etc.. nothing like this type of "community" in mainstream unless its based around some company.

The problem is that apathy is not specific to the adult industry...... mainstream acts the same way... only get involved when you are personally affected...and when it does.....who is there to help you?

actually, most mainstream industries are a LOT tighter knit than the adult industry is. There are thousands of industry gatherings and places to discuss issues in mainstream industries. Hell the real estate industry alone has hundreds of webmaster places, and with the virtual tours and all that they will be on top of acacias hitlist.

When RadioIO.com got hit back almost a year ago, there were minor postings on the mainstream boards for audio.. no one seemed to have cared.


It's great that people will talk about issues.. they do this all the time on slashdot...couple acacia related articles popped on, and people were posting about how sucky it was....but no walk, no action....

Correct me if im wrong here.

If OnCommand goes to court and fight acacia and you they lose, acacia then have the right NOT give you a license to use their "DTM" technology. So if they lose, they could lose their entire business?
